CBS/Paramount sues to stop Axanar

I think that AP is NOT willing to settle, and therefore has instructed his attorney to fight this one to the bitter end. To their credit, his legal team is doing their very best to create a novel and unique argument.
If I was CBS/P, I would not give a fig whether Alex Peters wanted to settle. I would not settle. And the more Alex publicly whines, the less inclined to settle I would be. YMMV
 
I'm honestly not at all surprised by this latest development, nor the continued, petty schoolyard gradeschool shenanigans of Alec and Terry on FB.

The only thing -- the only thing -- these dipshits understand is tit for tat ad hominem attacks. Peters especially, the shrimp dick man child that he is, simply cannot abide any kind of reaction to him or his actions and comments or let same go by without some kind of reprisal, some kind of baseless, transparent projection of their own insecurities and inadequacies.

As we have seen, several of us in the "haters" camp have accomplished more and can rest on the laurels of our careers and the work we have done. Peters is that little kid in the neighborhood who keeps wanting to come hang out with the older kids but whom none ever invite because he's just so damn annoying. He's Ralph Wiggum at 55. He's not just a mosquito that's about to be squashed by a boot, he's a buzzing mosquito on a sweltering hot day in the dead of summer that's about to be drowned in shaving cream and set on fire before getting squashed by that boot.

Burnett has, for years, harbored some inexplicable belief that he is "owed" Star Trek. Despite a very obviously middling career, his descent into madness following the ascension of JJ Abrams to the gatekeeper of the Trek franchise has been all at once pathetic and hilarious to behold. The clear break from reality here for Burnett is readily apparent if one follows any of his social media outlets on Twitter, Facebook or Instagram, and he has effectively torched any future career with any CBS or Paramount property given his petulant and seething temper tantrums during these proceedings.

The less said about Terry McIntosh, the better. He's a brute with the intellectual capacity of a dirty potato with only his own self-interests in mind and like Burnett, a tragic yet hilarious lack of understanding when it comes to the law or how to effectively persuasively communicate in a non-violent or legitimate way.

The latest legal shenanigans and parlor tricks will show no improvement for their cause nor will it strengthen the extremely flawed stance they have taken.

Pay these nitwits no mind, no matter how they buzz. The boot will drop and when it drops all that will be left will be the splattered mess of Alec Peters' broken, fraudulent dreams.

Keep hitting the nail on the head.

I wonder if convention visits and sushi count? Also, wouldn't he have to be paying State, Federal and FICA taxes on the salary he's paying himself?
I have argued in the past that meals and convention trips are probably legitimate business expenses because Alec and Diana were at the cons to promote the film and solicit donations. I personally have no problem with that kind of expense because it likely resulted in enough new donors to more than cover the cost. It's advertising. And meals while traveling for work are deductible, but you only get to deduct half the cost.

Any salaries paid would also have to pay FICA, but state and federal taxes would probably not be due in 2014 because Axanar had a loss. And as I have said before, depending on how Alec's CPA structured his depreciation schedule, he may have been able to use Axanar's depreciation losses to offset taxes due on other income, like Propworx income.

Just a note about the common refrain from the Axanar camp: "Why haven't they gone after the other fan films?"
When you go back through the many, many years of Axanar promotional material, what stands out is the idea that they were "different." They were "independent", "professional", "Star Trek like you have never seen it before", "the first professional fan production", " we use professionals that actually work in the industry", "we compensate our production staff", "we have legends in sci-fi community working with us", and many other examples. The basis for their entire promotional campaign and fundraising campaign was that they were DIFFERENT.
Why then are they surprised that CBS is treating them differently? You ask for special treatment, you get special treatment.
 
I don't think Gene Roddenbury would have approved of CBS/P's obviously monopolized tyranny of his creation. I think Roddenbury would have encouraged fan creativity.

Don't know who that Roddenbury guy is, but Gene Roddenberry on the other hand would stand proudly with the side that would make him the most money, so most likely with CBS, since I doubt Peters would be very willing to share either the "Guru"-role nor the hard"earned" donor money with GR.
 
From the Axanar FB here's an excerpt from a thread in response to Axanar's posting of the latest Hollywood Reporter article on the suit. I wonder how long it will be before a couple of people are branded as "haters" and banned.

I still think that, with the way officials with the new official Star Trek are singing the praises of Axanar, (Roddenberry, et al), the parties are signaling a willingness to craft a win-win solution.

I am wondering about the first comment. Are various known personalities taking sides for Axanar? The above seems to imply Rod Roddenberry at least 'sings the praises' of the project. Roddenberrys comments on Trekmovie certainly did not *seem* like praise. Is the 'everything translates to "AP" ' decoder ring club (in their sandbox) being told something?

Ask Fontana, Gerrold and Justman about how willing Roddenberry was to share credit. Or how Maizilsh and Arnold made lots of people's lives hell over Star Trek.

Our friend Karzak strikes me as the type of guy who's loyal as a blood hound if you're his friend or a decent person... but transforms into a post-apocalyptic marauder if you're a wrongdoer.

Totally unrelated: I just donated some clothes to charity and I hold doors for old ladies, Karz. Promise. Also, my only vanity project came from Ikea/my girlfriend. But I promise not to brag after I put it together.

Steak fries are delicious with a little garlic. As an added bonus, they repel vampires...elves...Vulcans...pointy eared generic sff characters.
 
Echoing what others have said, I think this latest MTD is weak tea. If it's an attempt by W&S to get plaintiffs to settle, I hope L&L file a multi-hundred page revised complaint, and include the tie-in merch this time.

I'm no legal beagle, but I can't see any way for CBS/Paramount to lose this battle.

if W&S keeps demanding more detail, at some point CBS/P will mix up which Suliban had which genetic enhancement, and Alec and the treehouse club will cheer as only true Trek fans can cheer at being the superior beings for knowing the answer. And then send out the Marines to declare victory since obviously CBS/P have been proven to not have any idea what they are talking about, and therefore could not possibly be the originators of Trek IP.

These are the first two posts I have ever liked on the new BBS. I just thought you two should know that.:techman:
