I find it amusing/interesting that nowhere in the answer are other fan films referenced or cited.

I guess AP was satisfied with just throwing his own fans under the bus by revealing they haven't done ANYTHING with 1.2 million bucks.

Sounds like Peters is pushing for the whole thing to get thrown out because CBS/Paramount never gave him specific rules to play by... when using their legally owned property to make a fan film... of their legally owned intellectual property.

Their case is built on a foundation of Jello.

They have a script that, by Burnett's own admission, was sent out to agencies for the purposes of casting, so that claim in their defense is, as Uncle Joe might say, malarkey.

EDIT: Also, its further proof that Alec Peters has no clue what he's doing as a writer in Hollywood. "A fully revised, locked script" indeed!

I will see about doing a read today and probably a deeper read over the course of the week and weekend. This may turn into another blog post or maybe a post after the CBS/Paramount response comes in; I'm not sure.

I'll be looking at the cited cases. That is going to take some time.

The interpretations I am seeing upstream on this thread (there's a mixed metaphor for ya) seem reasonable but I want to do my own reading. Either way, if a segment of the defense is that there is no there there, well, this is a set of sworn documents, ain't it?

That's been my sense of it for a month at least. I never imagined Axanar would hand it to them on a platter, though.

It is entertaining to see the attempted obfuscation of the docufictional work Prelude to Axanar by characterizing it as a mockumentary. It'll be interesting to see if there is any blowback from this as the process progresses.

And again with the profit rather than personal enrichment. Though I would have hoped that Ranahan would have pointed out and put a stop to the collection of "donations" for Prelude to Axanar as those funds plus the value of all remaining assets from that production can be considered direct enrichment of Peters.

Axanar doesn't yet exist as a concrete creative work, and yet it is better than a film the defendants, including the attorneys, have not seen? If that's in the document, its Bill the Cat time.
