CBS/Paramount sues to stop Axanar

Yep, shipping out a patch to 10,000 donors at $.49 per patch is $4900. A minuscule amount of the overall budget but a shit ton of work.

But, it needs to be done, this is what Axanar signed up for. They can get people to volunteer to help out with the labor.

Don't they have a "fulfillment officer" or something like that?
Who gets paid to fulfill because they're a professional fulfiller, not just your regular fan kind of fulfiller mind you.

No they don't use anyone professional. Diana is responsible (and also gets paid) for fulfillment

Anyone else getting "error 552" when trying to pull up the Axanar web page?
Yup.

I guess this means a change in plans from a week ago when they were going to hire someone to help with perk fulfillment?

Except we haven't seen any evidence of her being paid, just a line item of her salary being "deferred until 2016" on the Annual Report.

Oy.

This is why I don't practice any more.

This is such an easy way for someone to spout off, in the heat of the moment, all sorts of things that will end up as exhibits, in the current matter and potentially in a future matter or matters. It is a way to make a defense all the more difficult.

I really, really wish the potential Doe defendants (some of whom are pretty damned obvious) would start playing the long game. Calling out journalists and bloggers and podcasters to try to make some elusive and ever-moving point is not the way to do that.
Well, SOMEONE at the legal team must have gotten something through Mr. Peters head as the 3 minute Axanar feature Vulcan scene (with Gary Graham reprising Ambassador Soval). So I guess someone was able to get him to see that having a blatant copyright violation on the internet regarding the unlicensed feature CBS/Paramount is suing over isn't a good legal strategy. :guffaw:

Yet "Prelude..." is still out there.

Did one of you guys set that up?
So do you think there is any significance to the Axanar website being down?
Robert Meyer Burnett continues his desperate plea for me to interview him. He took to yet another late-night Twitter tirade, and while it was entertaining, it was also sad.

He so desperately wants to be interviewed. But only two outlets even considered it, and both turned him down. So now he thinks he can call me a "pussy" or challenge me in some way to do it. Nope. Still not interested.

I told him I'm not really all that keen on interviewing has-been directors who can't see past their own nose. Also, I only interview people who I feel will at least attempt to give me straight answers. And I don't respond to desperation.

I did tell him that he will get an interview soon enough. It will be as part of a deposition with the lawyers from CBS/Paramount, but he can pretend that's an interview.
So the guy insults you, and then gets mad that you won't interview him. Maybe he'd have better luck if he didn't insult you....

Yet "Prelude..." is still out there.
Prelude was released before the lawsuit (and been shown and gotten awards at Cons and Film Festivals) - IE that ship sailed and there no way to deny Prelude. The main thrust of the suit is against the Axanar feature at this point so that 3 minutes is particularly damning to the defense; yet was left up for nearly 5 weeks after the lawsuit was filed. I have to think Mr. peters lawyers really didn't know the mindset of the client they were taking on; and are just now finding out how he actually views things and are starting to try to reign him in and at the same time seeing what an actual godawful mess of a situation they have to deal with. I doubt they're happy and are probably realizing the chance of bringing Paramount/CBS to a settlement discussion is nigh impossible at this point.

I'm just waiting for the inevitable. Peters, Burnett, McIntosh and Kingsbury turning on each other in very public manner in an attempt to save themselves.

I do have a feeling that not only will they turn on each other, they'll turn of their pro bono legal team once no settlement with Paramount/CBS is able to be brokered and the Judgement against Axanar is handed down and Peters and Co. lose their proverbial shirts in a BIG way.

Oh she is, Alec has mentioned it a few times. Also the annual report is not evidence. Evidence would be an independent 3rd party audit trail tracking the expenditures of this project
I don't know if I can believe anything Alec says anymore.

There's a post by Terry McIntosh on the Axanar Fans Group Facebook page that the Axanar site is down for "around the next hour" for maintenance.

That's what is so funny about this, J.D. I mean, this guy has a screw or two loose.

He posts a comment on a Facebook comment area for G&T, and never hears back. So instead of thinking that maybe they just didn't get it, he calls them out and labels them "poseurs."

Then he spends 90 minutes begging me to interview him, I mostly pass, but out of respect for him, say I would think about it. Remind him he's already on record anyway, since we never established OTR. And when I decide to write about him without giving him his interview, he goes off on a tirade, lobbing insults at me.

Then when our social media people do an ICYMI Twitter post, he goes off on another tirade, and then deletes it. Then he gets in some pissing contest with Jody Wheeler, who simply walks away the bigger man, and I jump in ... and he's begging me again to interview him, while at the same time sending insults, lol!

It's like he's entitled to have an interview, and that the fact I don't want to interview him makes me a pussy. But here's the thing, he already subjected himself to an interview, and he already answered the questions I cared enough to ask. I have nothing else I care to ask. lol
