CBS/Paramount sues to stop Axanar

If he loses everything, will CBS take the cat too?

One does not screw around w/ the system and walk away scott-free...

A very large part of all this is the unfortunate result of Peters simply not knowing nearly as much about Hollywood as he thinks he does or as much as he likes to broadcast to the world that he does.

Make no mistake -- this entire debacle is going to destroy any chance he has at starting a reputable or successful career in this business.

According to Peters on Facebook, the film isn't even cast yet, (although filming is set to begin in February) and he says that's completely normal.... So.. now with a potential injunction hanging over the head of the production, I don't see anyone trying out...
 
$150,000 per infringement can be very, very costly...



I'd fully expect a few delusional fans to call for a class action suit against CBS/Paramount, but it'll be all talk of course.

Peters will be crowdfunding his next film venture before you know it, with the full support of his Axanar followers.

i was thinking this last night myself. He takes a hit here. Grabs the Axanar script. Files off the serial numbers and reuses it to make a low-budget (Asylum level) sci-fi movie. Completely funded by his loyal fans--- who will cry to the heavens that is is a 100% better than Star Trek

He wont have the money after the suit and fans wont give him enough money to get it done.

Never underestimate a fool and his money. Especially f Peters sells it as snake oil, "the story so Good it got shut down!" My take on the man is that he'd make for a good Televangelist.

They're not the only ones venturing into merch. This one from Renegades failed its Kickstarter, but it also looked really tacky as far as piggybacking off the Trek IP and tiptoeing around it in a way that telegraphs they know they're on shaky ground.

So I don't think it's entirely fair to single out Axanar on this front.

P.S. It was even supposedly a Kickstarter "Staff Pick" so the people at Kickstarter themselves really do not have a firm grasp of these issues either.

Is this even money that they are counting in their fundraising drives? I hope he kept very detailed records, because after CBS is done with him, the IRS might come sniffing around.

Legal issues all over the place,

Help us fund the Axanar full-length feature film by purchasing Axanar Coffee. A portion of the sales price goes directly to the film-makers of Axanar
Why would ever say it goes to the film-makers? It should say a portion of the sales prices is gets donated to help fund the Axanar Production.

Also there is no copyright acknowledgements at the bottom of the page for CBS since they show Star Trek images on the site.

Alec was Lawyer? I Can see why he is not anymore.

They may be piggybacking on the IP itself, but the game seems to use no trademark or copyrighted items from Star Trek itself. So there is a world of difference.

Not a silly question at all.

It's a civil suit, so there can't be any jail time.

However (here comes the caveat), if the $$ has not been declared as profits/taxable income (possibly as business income or even capital gains), then the Internal Revenue Service, which is not currently a party to this particular lawsuit, could step in with a suit of their own. That one would be under Federal jurisdiction as the IRS is a Federal agency, and it could be brought as either a civil or criminal matter (not exactly how it happens, but I'm trying not to write a huge, long essay here). Often a criminal matter is preferred if there is an expectation that criminal fraud can be proven.

That is speculative as of now. It'd be a very good idea for the folks at Axanar to make sure their taxes are prepared by licensed professionals.

Hey, I'm wanting to move into a RV fulltime. Theres some sweet look 2016s on the lot. Maybe I can get the kool-aide drinkers...uh I mean fans...yeah, fans...of Axanar to crowdfund it. Call it Axanar RV. Cause apparently all you need to bilge pump these idiots wallets dry is put Axanar in front of it and say you're better than CBS and JJ is the suxor!!!

Beyond Renegades, which has lots of merchandise (though not quite as much as Axanar), are there other Star Trek fan films doing this?

I see nothing to do with Star Trek IP on that page at all. Please point out where you see a copyright violation.
