CBS/Paramount sues to stop Axanar

Looks like most of my posts were taken off the Axanar group page entirely. I cannot find them.
The sheer number of people posting insane drivel is quite astonishing.
What really makes me grimace is people continuing to use the likenesses of the pro actors. If these people really think the likes of Gary Graham or Richard Hatch are gonna hang around, they really are mad.
The only problem with that logic is that CBS legal has told the ENTIRE fanbase how they can and cannot use their IP. They literally had one of their legal reps in here, last year I believe, with a group of "dos and dont's" DO have a "Star Trek is property of CBS, etc.." DONT use stuff from JJ Trek. (Which Axanar has pretty brazenly done. Including using Robau and the Kelvin specifically.)

I'm actually surprised the injunction wasn't filed first. Unless CBS/Paramount actually believes they are going to collect damages from this. Outside of the Kickstarter, does Axanar really have the capital to fight the lawsuit or pay the damages? Doubt it.
The damage had been done by then I'm sure the wall of Lawyers made copies of all that to be used in the court case

Burnett I think was starting to feel the heat from this whole mess, sure he was all boastful & confrontational, AT FIRST, but I'm sure he was told, if you don't stop going down this route, you won't survive the outcome of all this.
Granted it was possibly said in legal speak, but yeah.
My question is *IF* Peters were to win, the only way I could see that happening, is by saying CBS hasn't protected it's IP, and tosses their ownership pushing Trek into the Public Domain....
Is that even a possible outcome? And if Star Trek were in the public domain, then that's it, game over, who would continue to create works based on a public brand, other than maybe independents.... It would be awful....

If, and its a big if, CBS did not continue to renew its copyright on Star Trek, yes, but not for another 46 years. (Copyright law for works published from 1964-1977 allows for 95 years from date of publication before needing renewal.) But with a cash cow like that, do you really think they wouldn't?

I sincerely doubt that a) Peters has a snowball's chance in hell of winning this and even more so, I sincerely doubt that CBS/Paramount stand any chance of losing their ownership of the Star Trek IP.

The 38k is what is actually IN the report. I will be interested to see how much he might have actually spent if a third party does a forensic audit of all the money raised and how it was spent. They could really be quiet as church mice on social media. This COULD get really ugly very quickly if they keep reacting before they think it through. If any type of actually fraud arises out of this..........Don't even want to think about it, but a fan film would be the least of his worries.
I don't know about the US, but here a courier can do it. In some places, it can also be delivered via mail man.

I mean, at this point what does he see as possible outcomes? Publicly shaming CBS/paramount into letting him make his movie? I can't see that happening..especiallly since this starts with a Lawsuit and not a C&D.... Does he think he can actually win, and what would that accomplish?
This is the exact scenario the Picard facepalm meme was made for. That last paragraph is one of the most self-deluded statements I have ever read. And I work with entertainers.
If they did have any chance of an amicable resolution, they torpedoed that with their childish reaction and their "rallying" of the troops.
The smart thing to have done would have been to say something to the effect of "This is Axanar. We've been served some papers. CBS and Axanar are having some professional/creative differences, and we're going to try and solve this as quickly and calmly as possible. Stay tuned."
Kept it calm, kept it civil. CBS may have been willing to allow Axanar to go forward with some changes.
