CBS/Paramount sues to stop Axanar

If I'm not mistaken, didn't Paramount have an official statement years ago allowing the fan made films? The studio was seeing them as fan produced "plays", and as long as there was no profit being made from the productions. Alec Peters could use that as an effective defense.

I think that went out the window when Peters started paying himself and select staff. It is no longer "not for profit" when you start paying yourself a salary from the funds collected to make the film.

No, he couldn't. CBS made some specific remarks regarding what fan produced stuff could and couldn't do.

1. Don't make a profit.
2. Don't use JJ Abrams stuff.
3. Place the "Copyright CBS" line on everything produced.

Alec, Axanar, et al, broke the first rule.

I think this (BS) lawsuit is a combination of factors:

BS? CBS would be entirely within their rights to completely decimate every single fan production. It would make them huge assholes in the eyes of Trek fans, but legally they have every right to do it, because Trek is their property.

Yeah, on these very forums even. They had a small release on what the new rules were gonna be a few years ago.

And the second as they were going to mention Robau and were using tweaked Abramsverse ship designs.

When things are tough? Talk about losing all perspective. It is a fan film. Everyone's lives will, no doubt, go on.
 
For years I tried to tell myself that Star Trek fans don't have "toxic" style fans as part of the group, the past few hours has opened my eyes... The folks at the top really think they can win against CBS / Para and their followers getting behind them... Wow... Just wow...
It'd be funny if it wasn't true... And sad as well that the fandom on the whole will now be seen as toxic in the public eye, as this is spreading to news outlets as we type.
 
The fact of the matter is that CBS doesn't have to legally do anything to eliminate fan films other than go to YouTube and cite each film as a violation of their copyright and trademarks, and poof, there go all fan films. Won't even need to hire a lawyer to do that. Sic a secretary on us all through YouTube, and there will be no more fan films. QED

The fact that they're suing Axanar speaks volumes.
 
I can't vouch for anything else, but I'll testify in court that Nick. J. Cook is a classy guy.

I used to be really active on the board....The last few years of Berman/Enterprise wore me out. There was nothing but hate everywhere....Trek Fans have earned their rep as being a bit insane. Proving it again the past day or so.........

Oh I am sure he is Dennis just seemed like to me he was digging at the ones who didn't contact him. I do not blame them, they are most likely trying to take cover and protect their own projects.....which is just wise at this point.
 
If they did have any chance of an amicable resolution, they torpedoed that with their childish reaction and their "rallying" of the troops.

The smart thing to have done would have been to say something to the effect of "This is Axanar. We've been served some papers. CBS and Axanar are having some professional/creative differences, and we're going to try and solve this as quickly and calmly as possible. Stay tuned."

Kept it calm, kept it civil. CBS may have been willing to allow Axanar to go forward with some changes.
That would be smart. Too bad.

And we take this statement on face value because...?????

Because from a legal perspective it makes sense. If CBS gave direction to someone who isn't licensed to use their IP, ont HOW to use their IP, it opens CBS up to other parties claiming they abandoned their IP, putting their claim on Star Trek in Jeopardy....

Sorry ignore me - I read your statement back to front.
That doesn't make sense. CBS could have released some more detailed guidelines, with the written, bolded caveat: "Star Trek and associated content is and remains the property of CBS/Paramount/etc. Usage of Star Trek property by unlicensed productions does not constitute permission and is tolerated solely at the discretion of CBS and may be revoked at any time" or somesuch. It's their property and they can choose to go after anyone or no one entirely at their discretion.

I wonder if a C&D had already been sent and ignored by the production team.... I would ask Alec on Facebook, bt I don't expect I would get anything but some snarky response.
I just asked on the Axanar movie page. I won't be surprised if my post gets deleted :D

Times are tough, says the guy posting pics of him and his friends sitting around having a laugh about it.

Could folks not drag me into their internet pile on, please? I don't think it's terribly out of order to message someone you know and wish them good luck when faced by something like this.

I am acquainted with a number of people in the fanfilm community, and I have no desire to see any of them lose their shirt over something like this. And before anyone starts with the character assassination, I'm not personally interested. I judge everyone on how I find them.

Others may have different experiences, that's fine, but your experiences do not define mine. And before anyone starts accusing me of naiveté, nothing could be further from the truth. But by all means, believe otherwise if you wish. :)
