CBS/Paramount sues to stop Axanar

So to recap:
1. It was Christian Gossett's fault he built the studio;
2. It was Elon Musk's fault for not offering him more money for his previous company;
3. It was CBS' fault for not taking Axanar "for free";
4. It was George Lucas' fault that he wasn't "born a Star Wars fan";
5. It was Teresa Jusino's fault for writing mean things about him on the Internet;
6. It was Allyson Gronowitz's fault for being a woman and standing in his line of sight;
7. It was the fault of every Hollywood studio for producing bad movies; and
8. It was the fans' fault for giving him too much money.
So, then, whose fault is it that he is a piss-poor manager?
 
I summarized the video on this AxaMonitor piece I posted yesterday, in which he admits building the studio was a bad call, and that Axanar suffered from mission creep.

Not to mention how he accosted the Mary Sue writer after the panel, complaining about the "hatchet job" the website did on Axanar a few months ago. He didn't realize the camera was still recording.

What a tool. He truly is a peter. And by peter, I mean dick.

Also, I call bullshit on the Elon Musk and Peter Thiel story.

I am not buying the mission creep backrev suggestion beyond the Prelude project. Any further, it is a way to make the more recent decisions look good faith actions of a project making a fan film, just unsound decisions, where there was clearly intent seen in the post-Prelude KS to create a business.

Somewhere between getting the Prelude funds and going for the next round, a business was conceived and set in motion.

Trying to backrev the entire history of this project to be a fan film as the mentality may have been before Prelude (or perhaps one has to go back farther), is an attempt to paint over very contrary facts. Alec isn't owning up to regretting trying to build a business off the back of fans and studio IP. He's only regretting being blinded by too much money. That's ridiculous.

And notice that one of the things Alec says could have happened if they hadn't overreached is that he would have gotten to play Garth. Vanity project.

^^^I'm sure Alec Peters version of the lawsuit will soon be:

Alec Peters: "I just tried to talk to CBS/Paramount and was making progress when the 'gung-ho' attorney, Ms. Erin Ranahan from Winston & Strawn, persuaded me we could win this lawsuit; and settle with CBS and Paramount to get Axanar made. I did my part by personally getting JJ Abrams and Justin Lin on board and involved; and I thought JJ had worked out a deal that he announced at the Star Trek Beyond fan event. In the end though I wish I'd never listened to her, and continued with my own negotiations. I'm SURE they would have worked if she hadn't butted in and made me fight the lawsuit. I KNEW better because after all, I AM a lawyer by training...all she did was complete law school and pass the Bar...what does she know?..."

If he signs a settlement, can he go back and sue W&S? Wouldn't accepting the settlement imply he resolved his issues with their performance? Wouldn't he have to fire them and get another attorney in order to assert they are liable?

Under California law, malpractice requires proof that a plaintiff "would have obtained a more favorable result" in the prior litigation "but for" the attorney's negligence. Read into that what you will.

Just for the record, Rand is now officially a recovering Axaholic who has fully renounced his former overlord. He says that he regularly received instruction from Alec on who to attack and what to say, even being provided with the text to post with no evidence whatsoever of its veracity beyond Alec's word.

Mr. Johnson, (if you ever read this thread).... is this one of the posts you were given instructions on what to say with no evidence provided for you of its veracity beyond the defendant's word?

Is Mr Johnson another ex-Axanut who has seen the light and now spews the same high level of vitriol on his old friends and he used to spew on paying donors and the like? Nice. What a human being.

I don't think you can trust guys like that, same as Friend Terry. It may well be convenient that they've switch sides and, sure, pillage them for information (as it appears is happening) but I personally could never write off the chances of them switching back, should the right offer come along.
