CBS/Paramount sues to stop Axanar

When he calms down, Burnett is likely to go through and delete each of those tweets. Right now he's just foaming at the mouth angry because this was probably his only shot, in his mind, at ever directing a Star Trek film.

EDIT: Though I do find it amusing to no end that the only way Peters and Burnett could get their names and Axanar into a legit, professional Hollywood trade (THR, Variety, Deadline) would be for Paramount to sue them.

This is really not the exposure you want, guys!

This really lays it all out:

"The Doe Defendants include, among others, those persons who aided in the writing of the scripts for the Axanar Works or producing or directing the films, and those persons who designed or caused to be designed the infringing sets"

"Defendands enjoy a direct financial benefit from the preparation, duplication, and distibution of the infringing Axanar works."

Based on my reading of this, the definition of "Defendants" is very broad, not just encompassing Alec Peters and his innermost circle. And the use of the word "among others" could make it broader still. It sounds like they are reserving the right to accuse anyone who was paid in any capacity of exploiting the IP to make money. So I'm most interested in finding out where they're going to draw the line on that one.

If it's just an Ares Studios thing, that's pretty isolated to Axanar. If they want to make a statement that these productions should not be paying for pro labor (actors, crew, or FX) that's going to have serious downstream ramifications.

“The Axanar works infringe plaintiffs’ works by using innumerable copyrighted elements of Star Trek, including its settings, characters, species, and themes,” the suit states. “The Axanar works are intended to be professional-quality productions that, by defendants’ own admission, unabashedly take Paramount’s and CBS’s intellectual property and aim to ‘look and feel like a true Star Trek movie.’ On information and belief, defendants have raised over $1 million so far to produce these works, including building out a studio and hiring actors, set designers, and costume designers. The Axanar works are substantially similar to, and unauthorized derivative works of, plaintiffs’ Star Trek television series and movies, in contravention of the copyright laws of the United States.”

“We’re doing what other fan films have done for 30 years,” Alec Peters, the producer of the Axanar films, told Deadline. “Maybe CBS feels threatened by the quality of what we’re doing.”

Guys, guys, guys. There's an easy fix for this. Throw in some sex scenes, retitle to aXXXanar and Bob's your uncle.

Porn parodies are demonstrated to be safe from copyright lawsuits.

I smell another Kickstarter!!!

Peters, a named defendant in the suit, declined to comment on the specifics of the suit, but said, “We plan to fully defend it.” He said the feature film will start shooting in February.

:guffaw:

I somehow feel sure there's something in the TOS at Kickstarter and IndieGoGo that addresses this, but, are all of the donors protected from liability in this? Because I could see a case being made that those people were actually paying the Axanar folks to violate CBS IP.

Not that I think CBS would pursue individual donors - I doubt they would do something that dumb - but I'm just wondering if they COULD.
I'll take "Against the Advice of Council" for 1000, Alex.
Yeah, I'm pretty sure he's hit a Daily Double with all of that!

I'm sure they can find some slashfic authors to help...

This whole thing would be fucking hilarious if his actions here weren't putting every single other fan production besides his in jeopardy.

I believe Mr. Mark Cushman is available.

:guffaw:

You remember the backlash from the fans regarding Cushman (who apparently also wrote the story for "Sarek", BTW, per the latest Mission Log) directing porn?
