Until he can't. Anxiety generated from the anticipation of response is far more debilitating than anxiety generated from the actual act. He will always be looking over his shoulder - pushing the boundaries bit by bit, yes - but not openly brazen about it, as has been the case in the past, because there's always the potential of the Sword of Damocles to come-a-callin'.
That would be a normal person's response. He's such a narcissist he thinks he can get away with it, and even if he gets caught, he thinks he can talk his way out of it. CBS made a mistake offering the settlement because it only serves to reinforce his egotistic belief.
Some of his recent antics like restarting the donor store but saying th donor store is under "ares studies" so it's all good are starting to get quite brazen. In fact, his whole argument that Ares studies can basically do whatever it wants is very brazen.
But CBS doesn't care and he'll keep pushing the boundaries, nothing will happen, and he'll keep pushing more. I'm starting to think they are right and CBS is worried about the bad publicity if they do anything.
I'm still thinking they're in the process of wrapping up the merger with Paramount. They have bigger fish to fry right now. Once all that drywall dust settles - predicting by sometime next year - I suspect they'll start turning Sauron's gaze to Axanar once again. Only a matter of time.
CBS doesn't give a shit about Alec Peters OR the people still foolishly throwing money at him.
They sued because of his claim (which he made publicly many times) that either:
- The STAR TREK IP was in the public domain
and
- Even if it wasn't the IP ownership was improperly transferred

As CBS was gearing up to retart Star Trek production via CBSAA; they didn't want anything public that would hurt their ability tom draw in and charge high amounts for various licensing fees - so yeah someone (like Alec in 2014) who had some actual Hollywood talent involved claiming that - "The STAR TREK IP is public domain/Not properly owned by CBS..." (and who also had 1+ million in crowfunding to promote that claim) needed to either be settled with, or sued into bankruptcy to retract/show IN COURT those claims were not valid.
CBS got exactly that in their settlement agreement (which CBS can trot out to any potential licencees who might know that history and try to use it as a bargaining point WRT the licensing fees CBS will demand - and yes, to see it they have to sign an NDA, but that's standard industry practice).
And at this point in time (4 years post settlement); since CBS got what they wanted and Star Trek is now again clearly established as theirs (and successful) - Alec knows he's have to do something REALLY egregious to get them to really sic their lawyers on him and haul him back to court (or binding arbitration) depending on the provisions of the settlement.
So yeah, Alec now bilking idiots out of $50K - $100K a year isn't a big enough of a blip on their infringement radar to pull out the big legal guns again. They have licencees paying top dollar to merchandise the latest STAR TREK installments and no one in the media (like TMZ et. al.) is even mentioning Alec or AXANAR - which they were back in 2014 and 2015.

CBS also needed to do something about the Star Trek Continues, etc. out there as well. While Continues and most of the other fanfilm productions weren't acting in bad faith, raising hundreds of thousands of dollars to make professional-looking episodes and movies was something that really couldn't be allowed to continue. Peters provided CBS a convenient target to implement fanfilm guidelines and essentially shut the rest down without having to go after them directly (with the resulting bad press). Now it isn't CBS being the bad guy, but Peters ruining it for everyone.
I hadn't really thought about it before, but now it dawns on me that no matter what happened, CBS probably would have put a stop to the professional quality hour long fan films once Discovery and Picard started.
It was fine to turn a blind eye when there were no series in regular production, but once that changed, I can't see them letting something that would be so easy to confuse for the real thing continue.

To be fair - ST:C continued their run and did I believe 3 more episodes AFTER the fan guidelines were released (all with former Trek actors, 40+ minutes long, etc.) and CBS never batted an eye (nor did they need to because no where did they state "We WILL come after you if..."; it was more "If you would like to be reasonably certain we won't have a problem with your fan film..."
And yes, I believe ST:C did cut their proposed episode count by 2 overall - but again, they still produced more AFTER the guidelines and faced no actions from CBS.
IIRC, they’d already finished raising the funds for those episodes before the guidelines came down, and were already on fairly good terms with Jon Van Citters, or whomever the contact was at CBS at the time. And since they had a defined end to their run, that batch of reasons is probably why they were let finish up without interference.
