After the final conflict between Steve Rogers and Tony Stark in Captain America: Civil War, Cap drops his shield to the ground, leaving it and his position within The Avengers behind.
He may have also left the Captain America identity behind with it.
If they want to do a crazy Captain America story, they could always bring in Will Simpson from Jessica Jones. I couldn't find anything on the MCU Wiki about how much IGH, the group that Simpsons was involved with and gave him the drugs, was connected to the US Government, but it does strike me as a possibility for another program trying to make a new Cap. I doubt very much they would actually do that, but would be cool if they did.A replacement Cap who makes Rogers change his mind about giving up the shield is a classic comic storyline. Been done several times with varying degrees of success. My favorite is the Englehart version in the 70's. Combing that with the Crazy Commie Smasher Cap storyline Englehart did in the same decade would be great.

I guess confirmation is nice, but he threw away his shield and was in plain clothes when he busted out his team. I don't think anyone didn't know this that saw the movie.
