    I haven't seen the episode in awhile but I assume that if any soldier is seen wearing old-school armor, it's for the TV viewing audience.

    Meaning, the TV show-within-a-show about gladiators that's broadcast to the Magna Roman public.

    The whole point was that they advanced to their "20th century" in clothing and technology. When you saw them as gladiators in the games, those were costumes representing their past. The Empire's police force were dressed like their police, with uniforms and helmets in some kind of lighter colored riot gear. These guys weren't stuck in 44 BC, so there's no reason to expect them to dress like they were.
