What does "coded" mean? Even the ever-reliable Urban Dictionary didn't have it.

Giving someone the mannerisms of a specific class without ever explicitly indicating that they are a member of that class.

The Ferengi could be argued to be coded as a Jewish stereotype.
 
To be fair, the op didn't actually ask for the name of the episode.

As for the OP's "head canon", I think it's bull. Tom wasn't that kind of person. He was put in jail for being in the maquis. He was never a violent person. Tuvok wouldn't cover his ass.
agreed. Maybe Tuvok would get him out of alien custody if he was guilty, but then he would have told Janeway and had him punished on the ship

He wasn't in custody, I don't think. His sentence was to relive his "victim's" last moments every 14 hours. And unless he was innocent, it's unlikely that it would have been rescinded.
