Spoilers Bonus scene from Season One Finale

Not with the amount of people (execs and lawyers) something like the black badges and Section 31 would need to go through in order to be approved. I'm sure Viacom had to give an okay too.

I wonder if this was meant to be the last scene of the final episode before they decided to do the Enterprise one. It even has a musical score, and a nice one too. I also noticed that the Clint Howard character appears at the beginning of this scene, seems to be still high.

Really? We were all expected to roll over and accept the new Klingons with their phony D-7s as a "retcon" and "visuals aren't canon." And now a Section 31 is using badges and you're crying fowl? Practice what you preach.
We don’t know if this scene is canon, and there is still 100+ years out from DS9 to explain it
 
Even if S31 is going to play a major role in S2 (I have my severe doubts), you can't argue about "TEH SEKSHUN 31 DUZNT WERK DAT WAI!!1!1!!"

What we see in DS9 is over 100 years after when DSC takes place. I'm sure a lot of things change in 100 years.

Not according to David Mack's novel. In his acknowledgements at the end he says he was requested by Fuller himself to use the Enterprise in the novel, as there were no plans for it in the show.

What the actual fuck? We know the Leland character is part of season 2's cast, and it is confirmed season 2 is going to feature Section 31. How much more does it take to make this scene canon? Are you really going to spin the gears of denial this hard in response to a plot development you don't like after spending the entire first season telling everyone visuals don't count as long as the lore is respected? Because, guess what, the lore is being respected in this case. Section 31 is being presented as a shadowy secret organization with no morals. The fact they now wear black badges is just a visual, and you yourself had already stated visuals are not canon. Also, retcons are apparently immutable law around these parts anyway, so this is a retcon.
 
S31 suck, they're completely antithetical to everything the Federation stands for and pretty much ruin the concept that the Federation are an evolved society, who stand by their morality and values even when things get tough. It's just poorly written drama that drags the Federation from 23/24th century back to the absolute worst of the 20th/21st century geopolitics.

S31 also are not the equivalent of the CIA/MI6, Star Fleet Intelligence is, S31 are a clandestine black ops organisation, similar to NATO's "Gladio" organisation. Super secret, engaged in terrorism (often in NATO countries) and near nothing is known about them even till this day (or even if they still exist)

As with the Black Badges. Star Trek Discovery has absolutely shit writers who never think anything through nor even understand the most basic of concepts from Star Trek. S31 would not wear black badges or appear in public in goddamn uniform. The writers 100% think S31 is just the CIA I absolutely bet on it. (STID made a similar mistake)

Some time during the start of the actual filiming production they decided on it.
