Should Tyler be charged with Dr. Culber's murder?

The two personalities were fighting each other, Tyler's was stronger then Voq's, L'Rell "killed" Voq's personae to stop Voq's suffering.

Seems pretty clear from watching the show.

'malice aforethought' is debatable as it appeared to be an 'in the moment' impulsive action.
That element is definitely made out - it's a more flowery way of saying 'intent' - so split second intent to kill (or cause grievous bodily harm) is sufficient. That's no requirement for any element of premeditation, contrary to popular belief.
 
There are a lot of compelling arguments on both sides, but none of them are definitive. I think there has to be an inquiry or preliminary hearing at the very least to establish the facts and determine if they want to go forward with a full trial. So yes, I think he has to be charged, and Culber's family would expect no less, they would want answers.

Not to be forgotten in this debate, if there is no reset and the Tyler character continues, then this issue becomes material for at least one good episode. From the writer's perspective this is something they wouldn't want to waste. So yes, he has to be charged.
 
Can Tyler be compared to Picard, or Tuvok, or anyone else being taken over by an alien?

If so, then "Tyler" is the impostor, in Voq's body. Why wasn't he taken to a facility the moment he was rescued? He had 6 months of knowledge on the Klingons. His debriefing is at the very least, long past due.

Starfleet comes off as incredibly naive here.

Tuvok "cured" Sudor, sort of like Lrell "cured" Tylok, but Sudor was locked away none the less. It was the only option they had.
 
What DNA was found on the victims throat or at the scene of the crime? Might be a good start to determining who killed him.

Does not work like that in trek. People under mind control or alien influence ALWAYS seems to get a pass. And with Vulcans around there is no chance to lie about it.
 
Can't we just call him Voq? When he was guilting Burnham into being his lover again, he said "something something because Klingons killed your parents, then you fell in love with one[Klingon]." He also says "Ash loved you."

Why is he talking like this?

How can L'Rell just "delete" "Voq" from Voq?
How can we trust her?

And most importantly...

Because, he is not Ash is he? Or is he Ash? I mean at the time He knew for fact he was Ash. Now he has been told he is a copy of Ash in a heavily modified Klingon body. How would you feel or anyone feel when you found out everything you know about you is a lie?

He is Ash, but he is also not the Ash he thought he was,

Because she's wearing their county blues. It was more a joke, because she has no hair
