CBS/Paramount sues to stop Axanar

It's on CBS v Axanar on Facebook too. My favorite part:

"Counterdefendants deny that Defendant Alec Peters “reached out to CBS” on multiple occasions, admit that Defendant Alec Peters spoke to Bill Burke and to John Van Citters, but state that Mr. Peters was never given permission to use Star Trek Copyrighted Works, nor was he provided with “guidelines” regarding ways in which he could use Plaintiffs’ intellectual property for his Star Trek film projects, for either commercial or non-commercial use, nor was he told that his use of such Star Trek Copyrighted Works would be tolerated."

Translation: "Alec Peters is a GODDAMN LIAR," now entered into public record, :lol:

Other bit? Axanar's talking point about Van Critters giving Alec permission to make Axanar is denied in the complaint. They also gave a general denial about the Comic Con meeting where permission was given.

Sorry to repeat what others have already posted, but my Trek BBS page didn't update to show the last few entries until just now. It's always curious how this site paginates and updates.
 
Lastly, in response to Axanar's mention that Lin and Abrams said the case was going to be dropped / settled, CBS response is pretty much "Yes, that's what they said. So what?"

Those are the highlights.

They also say they lack sufficient information to assess the truth of the allegation in this case. Whether or not there is settlement discussion going on, wouldn't they know this and thus have information upon which to confirm or deny the Lin/Abrams statement?

There really isn't anything to confirm or deny about the Abrams statement. They can admit he spoke but not that he knew WTF he was talking about. Easiest way to do this is to simply deny the statement and let counterclaimants prove any of it.
 
I've never really understood this bit of behavior. Professional microphones are expensive and not I would expect really designed to just be dropped at will. Do these people also let go of the steering wheel on the highway if they want to make a point while driving?

Now the inevitable question is...

Was CBS/P prepared to let Alec off with a wrist-slap until the counter-claim?

I'm sure opinions on this are split, but it seems that way to me.

Either way, it was a really stupid gesture on his part. He should have seized the opportunity to do everything in his power to concede and settle.

With deference to the Legalese Expertise of Madame Chief Justice Jespah, does this "Response to Prayer" mean that High Lord Infringer doesn't have one?...

Yes and no. Studio mics can run up to several thousand $. However, stage mics for live performance are often built like Humvees to take exactly that kind of abuse. I have a decades-old Electro Voice that I used as field mic when I was a reporter. I never used it to drive nails, but in a pinch, I could have!

Yeah, "he said, she said" won't get anyone very far in court. I really believe that when the other shoe drops, it going to be the equivalent of several pairs of concrete galoshes.
