A couple of points lost in the furor over the Axanar "Boomer" patch...
"First, Ken Burnside of Ad Astra Games has got his Squadron Strike: Axanar game spooling up!"
Interesting. Looking over the game, it appears to use copyrighted imagery. Wonder if Loeb & Loeb have this one added to their file.
"As to the patches from the first Kickstarter that have been sitting by Diana’s desk for 9 months while we have waited for Terry to finish Ares Digital? Well, we decided that if Ares digital isn’t finished by the end of the month, we will either use Backer Kit or use Kickstarter directly to generate the labels to ship these out. I am sure you would all like those patches, and I am VERY tired of them not being sent out. So we will get these to you shortly!"
A couple of points. Generating labels is a pain in the balls, but seeing as Diana #1 seems to have some time on her hands, I imagine she might have been able over the past NINE months to hand input the address labels.
Ares Digital isn't ready? Hmmmm... seems Heat Packing Terry is overwhelmed by his four 10 hour days.... or isn't all that interested in focusing on a non-paying or never-gonna pay job.
Finally, the patches have been sitting on Diana #1's desk for 9 months? 9 months? While patches have been flying out of the donor store?

It's an old story, and someone isn't filling in all the blanks.
But hey! The Axanar folks have had patches for 9 (!) months and haven't sent them to the donors. That's news, ain't it?
As far as that game goes, since it's not up on the donor store or otherwise linked more directly with Axanar itself (more like an unaffiliated/distant merchandising tie-in) , would that be a case that would have to be pursued separately, or could L&L just say 'to hell with it' and lump it in anyways?
It does look from outside like "Ares Digital" is actually an add-on offered by an IT person as their personal project, and that the IT person does not necessarily want to do every possible labor associated with operating the studio, such as cleaning up any problem with the labels.
I do not know this is the case, but if it is, then a *competent* non-profit manager would know this situation innately. Volunteers who provide services may not want to do everything, and may promise to do so but not come through for whatever reason. Its not the same as an employment relationship. If something needs to get done, you don't leave it for an unreasonable time with someone who has offered but not stepped up with a solution. You monitor and respectfully make changes as required.
This seems like another example of Axanar trying to get away without buckling down and doing the work to get the results. Waiting nine months then blaming it on a volunteer and saying "I will just have to step in and spend money" is transparent, all right.

I would think that Mr. Burnside would be the one targeted by any hypothetical CBS suit.
But it does go to show that Alec continues to foster/condone/tolerate copyright infringement, even using his own website to promote said infringement.
It could also be a convenient excuse to fritter away money that would otherwise be awarded to C/P eventually..........
It is also leaving out the fact that @carlosp has been pummeling them with the fact that Axanar's donor store is a revenue center, and that patches that should have been going to donor's are in fact being shipped to customers who visit the store. Somehow Diana #1 has been able to figure out how to ship those...
