In other news, apparently the trial has been moved up to January 31, 2017. Peters is still claiming victory could be his.


Who's ever happy to have his trial moved up? Of course it does mean they could get "Axanar" back into production by March 2017 in time for its June 2019 premiere.
So, there's a script, a prelude that sets it up, sets under construction, FX done, three minutes of film shot, a cast (what's left of it), costumes, and so on, but the movie is not in production yet. Yeah.
 
Doesn't the date mean the motion to dismiss was booted? That would be a dark cloud in front of their silver lining.

He did say "we expect to win at least part of that motion" (exclude the Axanar movie), which suggests his attorneys are talking they won't win the summary judgment. But the judge seems still to be writing the decision for up to a few weeks.
 
They say that they have not made the movie, but isn't the Vulcan Scene not a part of that movie? If so, they have created part of it

Yes the Vulcan seen was presented as the teaser to the film. So part of the movie is done the copyright infringed, cant change the past. The only benefit is they can reduce the number of copyrights violated to just to the Vulcan scene.

I thought that was presented as a scene from the movie.. Ergo, the movie is made - albiet in a small piece

Courts continue to schedule as if the case is moving forward, even if there are outstanding motions to dismiss, or for summary judgment. Obviously, if the MTD motion is successful, then the schedule would be cancelled. But they still have to schedule it.

That doesn't matter. What matters is what their intentions were as they raised the $1.3 million. That is what discovery would show.

One of the things that will be looked at? That locked script from August 2015 they displayed so proudly. That would be turned over in discovery. As would previous drafts during the fundraising and before the fundraising.

If they were raising money with the intent to infringe copyright, whether it's produced or not doesn't mean shit.
