CBS/Paramount sues to stop Axanar

Being in the state of California, might I suggest the case be transferred to the courtroom of Judge Sheindlin?

Lets face it, it will be the only way Axanar gets on the TV
Yeah but I doubt Judge Judy would put up with, but Alec 'I'm a lawyer by training' Peters and his two step.

(Los Angeles – March 29, 2016) – Yesterday, acting on behalf of both Axanar Productions and Producer Alec Peters, Winston & Strawn filed a Motion to Dismiss the first amended copyright complaint of CBS Studios and Paramount Pictures Corporation. The motion explains that in multiple respects, the deficiencies in CBS and Paramount’s original complaint are still not sufficiently addressed in their amended filing, and that in some ways the amendments have created new defects.
The motion provides examples as to how CBS and Paramount overreach in what they claim are elements protected under copyright, and fail to be specific as to exactly which copyrights have been infringed upon; and, in the case of the potential feature film AXANAR, claims of alleged copyright infringement cannot be made against a film that doesn’t yet exist.
One issue discussed in the Motion to Dismiss is the lack of specificity about allegedly infringed works at issue raises the question of whether or not Paramount Pictures Corporation even has standing in this lawsuit given that copyright extends only to new elements in derivative works like Paramount’s films, and the allegedly infringing elements at issue may ultimately all be from works that CBS claims to own.
Axanar Productions hoped that any amended complaint filed in response to its prior motion to dismiss would help narrow and clarify the scope of the case to put the parties in the best position to negotiate a fair and reasonable outcome. In the view of Axanar Productions, CBS and Paramount’s efforts failed in that regard.
According to Axanar Production’s Alec Peters: “So as not to distract from Star Trek’s 50th Anniversary year, the best thing for all parties to do is to sit down and work out a settlement that address both the interests of Paramount and CBS and the desire of over 10,000 Star Trek fans who donated to support this project.”

I think one of the first people L&L ought to call is a donor and ask, what did you donate to?
I donated to an Independent Star Trek Film, that I was told would be equal to or better than anything the Studio had produced to date. Mr. Burnett said in nearly every podcast they were making a $100 million Star Trek movie for a $1 million.
Did you know they were using the Star Trek IP illegally?
Mr. Peters and Mr. Burnett always said that they didn't own the IP, but CBS and Paramount graciously allowed them and others to use the IP so long as no money was made and they followed the rules. That if CBS or Paramount told them to stop they would have to stop.
Would you have donated to this film if the words Star Trek weren't used?
No, I would not have.
I'm sure they won't call ay donors, but I think for some donors it would be gratifying to remind the defendants of the crap they said in order to persuade people to give them money.
 
Wonder how the Axanerds are going to hold in their subconscious the simultaneous ideas that their brilliant leader created both The Bestest Star Trek Evar, and The Nottest Star Trek Evar. At some level they can't articulate, that HAS to hurt.
I think another round of kool aide and they'll believe what ever AP and crew tell them to.

Ah. So, really, it's all a delaying tactic, hoping to push for a settlement.
I really do wonder if he thinks he's operating from a place of strength.

Since Peter's is the biggest hater of them all, guess that's why he has been sued.

he could have achieved his film, written it brilliantly, and be respected by all, and he still would have achieved ONLY A FANTASY FILM. Yet he insists the accomplishments of every single person in the world who may disagree with him could not possibly compare with is accomplishment to date, that is write a script and assemble a sued commercial endeavor that failed to deliver more than a teaser for its project with more money than others need to finish.

People are not BUSY tearing down this sort of thing. He gives himself too much credit for being a target requiring intellect to analyze.
