CBS/Paramount sues to stop Axanar

Axanar Productions Statement on Motion to Dismiss First Amended Copyright Complaint.

Official statement from Axanar Productions on the Motion to Dismiss filed yesterday in US District Court.

(Los Angeles – March 29, 2016) – Yesterday, acting on behalf of both Axanar Productions and Producer Alec Peters, Winston & Strawn filed a Motion to Dismiss the first amended copyright complaint of CBS Studios and Paramount Pictures Corporation. The motion explains that in multiple respects, the deficiencies in CBS and Paramount’s original complaint are still not sufficiently addressed in their amended filing, and that in some ways the amendments have created new defects.
The motion provides examples as to how CBS and Paramount overreach in what they claim are elements protected under copyright, and fail to be specific as to exactly which copyrights have been infringed upon; and, in the case of the potential feature film AXANAR, claims of alleged copyright infringement cannot be made against a film that doesn’t yet exist.
One issue discussed in the Motion to Dismiss is the lack of specificity about allegedly infringed works at issue raises the question of whether or not Paramount Pictures Corporation even has standing in this lawsuit given that copyright extends only to new elements in derivative works like Paramount’s films, and the allegedly infringing elements at issue may ultimately all be from works that CBS claims to own.
Axanar Productions hoped that any amended complaint filed in response to its prior motion to dismiss would help narrow and clarify the scope of the case to put the parties in the best position to negotiate a fair and reasonable outcome. In the view of Axanar Productions, CBS and Paramount’s efforts failed in that regard.
According to Axanar Production’s Alec Peters: “So as not to distract from Star Trek’s 50th Anniversary year, the best thing for all parties to do is to sit down and work out a settlement that address both the interests of Paramount and CBS and the desire of over 10,000 Star Trek fans who donated to support this project.”

Another comment from the closed FB Axanar Fan Club group - this time it is Terry Mcintosh, the "digital guru" of Ares Studios and the creator of the "revolutionary" Ares something or other perk fulfillment software delivery service something and also an admin of the various Axanar groups, who is discussing the "haters."


You have folks that are rather insignificant (“writers” and low-end podcast) folks that are using their manufactured drama to help boost their brands, you have some folks that behaved poorly and were ejected from the Axanar group(s) for it, you have some folks that don’t care for Alec personally and that has carried over toward Axanar, you have a single handful that are involved (or were involved in the past) with “competing” productions that are predictably competitive, you have some folks that are weak of character and simply enjoy the drama, and you have a vast majority that are merely spectators.
That all said, it’s only Star Trek and it’s only Facebook. *shrug* Losers whine and winners have sh*t to do, which is why I, and many others, don’t bother with such people.
 
You know, I am a level headed person, and I am sure the Alec and others are viewing this, so...

Seeing as how they called me a liar, cheat and accused of making up stuff, I hereby challenge them to a duel with swords to be held in the car park of the Axanar Studios - no more Mr Nice Guy

Funny.... I'm working towards a Bachelor's Degree and potential doctorate in Astronomy. Jeepers.. guess I've failed to achieve anything. Might as well just give up on life and become a couch potato.

Unlike him, I actually plan on being involved with something that's actually useful and serves a purpose for this planet.
