CBS/Paramount sues to stop Axanar

I honestly can't believe the “Blue Warp Nacelles”/Sombreroprise thread isn't in there somewhere ... :lol:

Ah, good times ...

That thread was closed, so I would've discounted it... if it had more replies.

But it didn't. The "Blue Warp Nacelles?" thread only had 5,597 replies before closure. And that was over 4 years of discussion (2008-2012). This thread easily beats that, and in less than a month.
 
The Ares is not a rip off of the JJ designs, take it from the one who designed the ship. The others may be rehashes of the 2009 designs, but the Ares is a totally new design. (I speak here as just a Artist that has provided images for free to the project, I have no knowledge of the proceedings or opinion on the matter really)

I argue both that it is not new and certainly not original. I'm not saying you ripped it off something, but Star Trek over the years has created that unique Starfleet "look and feel" for ships, and I hate to break it to you, but i'm fairly sure you can copyright and trademark "look and feel."

CBS could probably claim infringement based on both the style/aesthetic as well as the various features used in combination: the saucer/pylon/nacelle/hull configuration, the top centered bridge, registry placement and "U.S.S. XXX" and "NCC-####" designations, the glowing nacelle tips-- not to mention the Starfleet "delta" insignia.

Let's not forget that various Star Trek shows as well as games, novels, comics and toys have created new ships of the same "look and feel" and if we look deep enough i'm sure we'll find one with a similar look to the Ares, even if the detail may be different.

Because at the end of the day, if an average person-- even a non-star trek fan-- were to look at the Ares, there is no doubt in my mind they would identify it as a ship from Star Trek.

Let's make sure we differentiate between something that is intentionally stolen from another work, and something that simply has a similar design by coincidence.

In this case i'd argue it's more than coincidence, but still not stolen: when designing a Starfleet ship that you want to "look like a Starfleet ship" it's more than likely you'll wind up with something similar to something that's been done before given the amount of ships that have appeared in Star Trek, it's spinoffs, books, comics, games, toys and other works.

I am not here to argue. I am a fan myself that got pulled into this, and I made no money off of it. I will not get into it like some on the production. I am trying to be far and for the most part keep my mouth shut. I love Trek and personally wish we all could get along.

I was trying to make a joke. I think it's a neat looking ship, obviously Starfleet, but something that looks like it'd be from the 2240s, especially with what we know now from the 2009 movie.

Well I am sorry you got dragged into this. You did do some great work and it's a shame that it's associated with such a controversial production. Perhaps you could eventually work for Trek proper, as you obviously have the chops for it.

Oh I so want to work on something official for Trek, As I said I love Trek and want it to keep on going.

I do recall something in past writings about the start of Trek, that the TOS Enterprise reached its final design when someone flipped it from nacelles down V to up. This design lacks the neck but otherwise, to me, it seems very close to the contoured body of one of the later Enterprises, combined with elements of the TOS ship. Without criticism, I am not at all clear how rearranging some distinctive components a bit achieves sufficient distance from the copyrighted designs to be safe.
