CBS/Paramount sues to stop Axanar

As I know Alec Peters (and several other independent producers this might affect) I have to suggest that this could be a big mistake for the studio and the network to go after fan films. Most of the fan film producers are good guys, they are enthusiastic fans. (Even the one or two I don't like very much.)

It's likely going to piss off the fans and damage both Paramount and CBS' relationship with the core audience -- and that audience is already seething about the way Trek has been presented in the last two movies.

The fan films have, to a great extent, recaptured the spirit of the original series, something that seems to have eluded some of those who have actually been entrusted with custody of the franchise.

Too often, Star Trek has been reimagined and reinvented in someone else's image, and the result is not the Star Trek Gene Roddenberry created. (Gene seethed about that too -- but Gene wasn't always right either.)

With this action, CBS and Paramount are sending a strong signal that their intention is to shut down not just this fan film, but any fan film that they choose to disapprove of. In this case, I would guess it's because Axanar has raised too much money and intends to create a truly professional-looking product.

What some have suggested -- and it's an interesting thought -- is that Paramount has a new movie coming out in 2016 and CBS has a new series planned. It could be that on some level they are concerned about the inevitable comparison with Axanar and other fan productions. (Especially if the fans demonstrate that they can do for one million dollars what a studio can't accomplish with 100 million.)

But the lawsuit suggests that CBS and Paramount might be missing the point. The fan productions are about the hunger for new Star Trek. They're not competition as much as they are signs that the franchise is alive and well. Keeping the fans engaged is the best thing that CBS and Paramount can do to keep the franchise

They keep point away from that, they point towards the other FanFilms (WHICH IS WRONG TO DO) and point to everything but what was said by CBS.

You have tons of issue with the production and no one was to answer questions.

One example. They bought real from props (Enders Game) for the production. What happen after Axanar can Alec sell them and make money off of them?

The list of things goes on. Another example, does Alec get Paid for being in the fan film? Is he being paid for other jobs in the fan film?

Maybe someone can point me to the answers.

Agreed. Peters' tendency to shift attention away from himself or his production when things like accountability come up has been well documented and disappointing to observe. He is utterly incapable of accepting he might have made a mistake or admitting where he may have been wrong. He just hides it all behind his own anger (see: his tweeted response about Tony Todd).

Very likely he could. And if he's still schlepping items on his old "Propwerx" brand, he could probably make a pretty penny from them, as well.

I would assume yes, he would, as he somehow finagled his way into SAG last year.

Sorry, but appearing in fan films and a few shorts produced in your acting class doesn't really strike me as being a legitimate means of getting into SAG-AFTRA.

More likely, his reasoning was that he Taft Hartley'd himself thereby allowing him to join SAG-AFTRA. Since this is Peters' pet project, it makes all the sense in the world that he'd view himself as exactly that for his personal fan film about his hero Garth.

Without a doubt, using a web series you’ve written for yourself, and produce as a SAG-AFTRA New Media project, is the most direct path. While you’re at it, you can write in parts for your union-hungry fellow actors, and Taft-Hartley them in as well.
Why?



Because of one simple thing: money. Follow this carefully: over the last couple of years of SAG and AFTRA’s separate existence, prior to the merger that created SAG-AFTRA, as the former leadership of SAG insisted on an ill-advised refusal to bargain on the TV Theatrical contract, mostly over new media issues (irony, anyone?), a frustrated AFTRA broke away from the Phase 1 talks, bargained separately, came to an agreement almost immediately and took the lion’s share of 2009-11’s pilots that went to network air. Oddly enough, the same thing happened this year, despite a SAG contract being in place. Sadly, it was clear that the producers would rather play with AFTRA than SAG.

The unintended side consequence to this dramatic shift in contract concentration meant a huge shortfall in dues and producer contributions to SAG, while AFTRA was enjoying an enrichment they’d never seen. That shortfall at SAG caused them to relax certain rules, and Taft-Hartley restrictions are amongst those relaxations.

So – if you want to get into SAG-AFTRA real bad, do this:
1. Write a multi-part, multi-actor cast web series – no one episode “series” or one-person shows
2. Produce it under the SAG-AFTRA New Media contract (you must hire at least one SAG-AFTRA actor, but you can defer payment)
3. When you go to union HQ to sign your paperwork, if they don’t bring it up, ask how to Taft Hartley your non-union cast members
4. Taft Hartley your non-union cast members, including yourself

That’s it. And, there’s no charge. Enjoy.

Under that basis, he could easily justify paying himself, even if it's completely, morally gray.
