CBS says it CANNOT go forward with ANY new Trek series?

If and when CBS feels that making a Star Trek series will be a good financial move, they will make it, and all those "top entertainment" attorneys will accrue some decent fees clearing any existing legal hurdles.

And yet they can do both DC and Marvel, which you think would have an agreement precluding that.

Lego has many, many, licensed lines that they don't really need to add Star Trek to that mix. I've seen a variety of private creations that are well done for Star Trek, but that doesn't mean that LEGO needs to acquire the license. Honestly, with LEGO focus on more younger kids lines I don't see them wanting to get that.

Also, Mattel acquired the license for Mega-Blocks merchandising. And Mega-Blocks use of the Barbie and Halo lines don't seem to be hurting LEGO's sales at all. I don't think adding the Star Trek license, as much as I and other fans would like it, would be beneficial to LEGO.

Mega Bloks once again has the license for Star Trek construction toys (they released an Enterprise-D set about a decade ago). At this year's licensing expo, they revealed an upcoming new line based off TOS. Maybe if it does well, they'll expand it to cover other Trek shows...
