During the interview with Dr. Phil, Juan makes the comment that if Jodi had not left behind the camera with the photos of her and Travis as well as her supposedly dragging Travis down the hallway that he would never have been able to charge Jodi with murder. Yet Juan did in fact charge Jodi with murder even though a contradiction existed that would have proven Jodi did not kill Travis. A contradiction that Juan stated on T.V. that he would not allow into the court proceedings.
That contradiction that Juan did not allow came in the form of Enrique Cortez statement to Detective Flores on June 10th, 2008 that he had seen Travis still alive on Weds June 4th, 2008 between the time of 6 and 6:30 pm after Enrique had arrived home from work. Juan did not allow Enrique Cortez to testify because if Juan had then the defense could have used Enrique's statement of seeing Travis still alive to more than suggest that Jodi had not been the one who had killed Travis. Based on Enrique's statement of seeing Travis still on June 4th, 2008 that he made on June 10th, 2008 Enrique would not have known that the photos with Jodi and Travis on the camera or the images of Travis being dragged down the hallway after being murdered would have even existed. This would mean that Jodi did not kill Travis nor did she take the images of Travis being dragged down the hallway but such time and dates were coerced out of Jodi to ensure that Juan could place her at the crime scene when he needed her to be there in order to get his conviction of murder. Because Juan did not allow Enrique Cortez to testify Juan did in fact commit felonious prosecutorial misconduct in keeping the evidence from the jury.
What areas of prosecutorial misconduct would Juan be guilty of?
Courtroom Misconduct: Juan introduced evidence designed to prejuidice the jury which in this case was the deleted photos on the camera showing Travis being dragged down the hallway where Juan made the jury believe that it was Jodi and no one else in those photos of dragging Travis because she had been proven to have been at the crime scene based off of DNA and a palm print along with Jodi's hair.
Improper Closing Argument that included the photos mentioned above to further sway the jury to believe that Jodi had planned and killed Travis.Hiding evidence - Keeping Enrique Cortez from testifying because Jodi's defense would have been able to introduce the statement made of seeing Travis still alive as a counter to Juan saying that the images on the camera proved that Jodi had been the one who had killed Travis. Like I mentioned Enrique would not have known that the photos showing Travis being dragged down the hallway would have existed at the time when he gave his statement to Detective Flores and therefore Travis was still alive countered to Juan's use of the photo's to once again sway the jury to convict Jodi of murder.
Failing to disclose evidence that might tend to exonerate the defendant. This would involved once again Juan failing to disclose Enrique Cortez as a witness so as to deny the defense the ability to cross examine Enrique and his comment made about seeing Travis still on June 4th, 2008 after the time date stamps of the photos show Travis to have been dead. Jodi would have already have left the crime scene on June 5th, 2008 when Enrique said that he thought the murder actually took place. Evidence that coupled with Enrique not knowing about the photos on the camera when he gave his report to Flores might have tended to cause the jury to exonerate Jodi in the murder of Travis if they had heard Enrique's testimony and the defense team able to cross examine him.
Presenting False or Misleading Evidence : This once again goes back to the photos mentioned earlier showing Travis to have been dead and the time and date stamps applied to the photos to suggest that Jodi had been present and had planned and killed Travis, which is also coercion and tampering with evidence. Misleading or false evidence because it was never proven who it was that was actually in the photos that once again could not have been Jodi because Jodi would have already have left the crime scene by June 5th, 2008 that with Enrique saying that he had seen Travis still alive on the evening of June 4th, 2008 and not knowing about the photos of Travis being shown to have been dead by 5:32 pm on Weds June 4th, 2008,
that Travis was in fact still alive and that Jodi did not kill Travis.
How can Jodi have killed Travis based on the time and date stamps of photos showing him to have been dead before the time that Enrique said that he had seen Travis alive on J0408 when Enrique did not even know that the photos of Travis being dragged down the hallway even existed at the time he gave his statement to Detective Flores because the crime scene had yet been processed and the evidence analyzed?
