Was he actually promoted to full Commander to take command of DS9?
Or he was promoted to full commander to be CO of the shipyard, and retained it when he was transfered to DS9.

Probably more of a Project Lead (or even a deputy if we assume that Shelby was in overall charge of anti-Borg projects as implied at the end of BoBW pt II) rather than the overall yard superintendent.

Honestly, my main issue is that he appears to have been in some way involved in the Defiant project, but was also -- per Way of the Warrior -- director of an orbital habitats construction project.
Those two things don't go together IMO.
If it's the equivalent to the modern day Newport News Shipyard (which I believe) then Utopia Planitia is owned and operated by civilians. Starfleet would have a presence there, but don't run the place.Somehow, I find it hard to believe that the CO of Utopia Planitia -supposedly one of the more important shipyards of Starfleet- would 'only' be a commander.
More likely this.Then again, I never believed he was supposed the be the CO of the shipyard, just a commander working there.
