What'd be the Doctor's punishment for getting frisky with a patient?

Julian should have gotten jail time for sleeping with a mentally ill girl like Serena (The mute super genius) gods forbid just have his license revoked for sleeping with a patient who was almost mentally sound. It's an abuse of power if not a dick move in every light.

But Nada.

It's probably because Bashir is so hot that no one arbitrating right and wrong can see the downside with using him like a jungle-gym.

The Doctor on Voyager however?

I'm not saying he's not hot enough to get away with being sleezy with the female patients...

But when he propositioned Seven of Nine?

In the final episode...

Seven of Nine asked for the brain surgery to allow herself to get off emotionally inside a healthy romantic pairing and he decides to get in on that.

What a deush.

Now she has to be suspect of every motive and drive in his shiny little ligthbulb brain that he wasn't trying to trick her into doing naked star jumps.

How can Seven be entirely secure in letting this "program" touch her, gods forbid letting him touch her while she's gassed asleep and unable to protect her virtue from his curiosity?

There is no way that she should have continued with him as her primary physician unless she was allowed (yeah right, allowed. Good one.) to go into his his brain and gut any and all sexual and loving feelings toward her since, quid pro quo, if she was willing to do that herself, how could she not be sure and afeared that he wouldn't abuse the opportunity to program her to be in love with him when his fingers were inside her brain pushing her incentives and directives this way and that till he pleased himself with her new mode of thinking that he is her personal emergency sex kitten program?

And that's just if she rejected him.

What if she was into what he brought to the party?

He'd have to recluse himself.

Seven of Nine wouldn't have a Doctor anymore.

She has a serious medical condition.

Seven would die without a Doctor maintaining her dripping taffy slow resumption of humanity.

Unless they brought the emergency backup out of mothballs who would be ape that he was still being CCed all of the Primary EMH's memories except anything related to touching Seven of Nine's tatas.

Kane killed Able over something a billion times more petty.

This way madness lays.

Janeway would have no choice but to selectively mindwipe and reset Both the Doctors programs to some point before either of them met Seven of Nine, and order the Borgette to only dick over real live boys and stop vandalizing the ships "fixtures and fittings" with her emoterrorism, as Seven is blubbing "You can't kill him, you can't kill the man I love! It's not fair! It's not fair! Just because you're an old maid no one would touch where you keep your cobwebs with a ten foot barge pole... "

His punishment? Easy. Delete his penis.

When EMH [Mark I] was talking to EMH [Mark II], our good doctor mentions he made additions to his program. So if this happened, the doc has all the knowledge and capability to restore it.

On a slightly related note, why did Mark I and Mark II have to talk together at all? Shouldn't they just communicate via the holo-emitters and related circuitry? (I know their verbal banter is for our benefit though.)

I still don't understand how, why or when the Doctor developed a sexual desire subroutine? They act like he always had sexual desire, without phermones or testosterone. Why would a medical program be program with carnial desires?

Sorry, I just don't understand how something like PS3 could desire sex to want to expand his programming. Data has a penis but he was still a machine. He didn't have sexual desire. He never sought out Tasha before nor after their one night stand. Is the EMH superior to Androids?

The Bad Guy in Flesh Gordon and the Cosmic Cheer leaders was using an "Impotency Ray" so that he was the only man in the galaxy capable of an erection. Other than that... Itchi the killer had people cutting off feet for sexual arrousal... But pleasure from groinal dismemberment.

I saw Picardo on Stage saying that he had no bloody idea when the Doctor got a penis when he was first reading the script to message in a bottle.

Makes me wonder how many of the lightbulbs we see are Ken and barbie dolls?

Well not completely.

The Doctor has (nearly) always wanted to part of the crew associating on their terms as an equal, identifying and empathsizing and to do so he would have to understand boinking clearly as much as doing himself with "the flu" or watching his child die.

Besides everything he did was calculated to distract and entertain the crew as he fumbled about to cut down on the crews space madness and mass sucidalness.

The doctor was barely AI. It was handicapped to think and react at human speeds (Blink of an Eye excepted) probably because most people remembered the M5 and half a dozen other computers trying to take over the galaxy... We just survived Judgement Day again by the way, according to the revised dates provided by The Sarah Conner Chronicles.

The Doctor is the too perfect creation of Dr. Lewis Zimmerman. So many humanity subroutines were added and built on that he now has an expanded mission--not just to care for people medically and psychologically but to pursue understanding them. I think every single thing the doctor does not understand or relate to he must immediately pursue and learn how to be that thing. When he was activated he was just an EMH but the subroutines to take him further were lurking within, who knows what triggered them.

Anyway sexuality, romance.. all just part of the expanded mission.

It was Kes.

After Baxter treated him like furniture, she decided to make him want to be more "real" in the crews eyes like Caretaker never bothered to do for her people.

Kes was an Atheist, she didn't believe in the Caretaker.
However too a child, something like Barney is real.
That's how I figured Kes saw him, like Kermit the Frog.
Everyone kinda giggled at her at first over the idea that hologram should be treated with respect. To them he was just a toy. Too her he was "real".
It comes full circle in "Author, Author", where the Doc's rights are brought into question because the Federation see's him as something equal to fictional childrens story character.

Which is another reason why I still question was Kes a child or adult because she could distinguish that fact about the EMH. Was she wise or was it just that she saw things as black & white, like a child does? The advice she gave was often just common sense. Is that wisdom or just repeating what your parents taught you?

I think that Kes' fast growth allowed for accelerated mental growth as well.

So if she stayed on Voyager thru adulthood and as she mentally matured, would she eventually come to feel foolish that she saw the Doc. as "real"?

Getting into serious philosophical territory there, what is "real"? Is it defined by being biological? Does being made of photons make him less "real"? We've seen plenty of energy beings in Trek.

Again, the Federation sees the EMH = Barney

What makes the EMH different than a hologram of Donkey Kong?
Holograms to the Federation a just interactive SIMS people.
We've seen plenty of energy beings in Trek.
How many of them seeking equal rights under the consititution of the Federation?

From what we know, Q's could be energy beings but they still aren't seen as equals.

The woman in the story is an adult, and if it was consensual, then what's the big deal? Mental illness takes a lot of different forms.


Should someone with schizophrenia be forced to be celibate because you could never determine when they might be taken advantage of?

I don't see that Bashir did anything wrong.

I don't see sex with patients as wrong as long as its consensual and the relationship doesn't cause other problems or a lack of professionalism.

Depending on the mental illness it can argued that the patient isn't mentally sound enough for them to quailify as consensual. It doesn't matter if she's an adult or not. Her age isn't a issue. Realistically she's have to be reevaluated by several experts in that field to determine to what degree she is cognizent. Bashir is not a psychologist. He only observed that she responds properly to stimuli, she wasn't psychoanalized to determine her actual thought process.

Nobody is saying that and that's an extreme view of the issue. What's being questioned is the ethics between a Doctor/Patient relationship if it becomes sexual. Nobody is saying the mentally ill can't have sexual relations with other people.

Ethics ties into professionlism.
