Flux, it sounds like it went all right. Glad to hear that. I don't know how much stock I'd put in to EDD backpaying you for that month of unemployment though. Granted these are mitigating circumstances, but being that you're employed now and that it couldn't be all that much money anyway, it may well be worth it to have this black mark removed from your employment history and just move on.

Then again, maybe they will pay it. Either way, it sounds like the worst of this is behind you. And for this, I am glad.

I'm fully surprised the judge didn't just throw the whole thing out. The lawyer clearly didn't have anything she needed to back anything up, no proof of wrong doing.

Absolutely. You should be compensated for attorney fees and any other expenses (hope you kept records) and lost time/income from your job because of this nonsense.

They didn't even send a lawyer, they sent the district manager. I'm thinking she simply didn't expect me to show up. When she walked in and saw me already there she seemed surprised, and said hi as if everything was cool. :rolleyes:

I haven't even bothered with an attorney yet, it just doesn't seem necessary. I haven't even lost any time at work over it either, I was able to work out a shift trade to be able to go to the hearing. I do hope I can get the month of unemployment benefits I would have received had these jackasses not appealed my claim.

Yeah, that would have been a good question. I did point out to the judge that the bin in which the cable had been was itself thrown away. I effectively saved this cable from being thrown out along with the rest of the crap. The DM's only defense was "Well that's the discretion of a store manager to throw those away." In other words, completely missing the damn point.

In other news, I got another letter from that shady law firm that is seeking "damages" on behalf of RadioShack. The amount they are demanding has almost doubled now to $625. They're being so kind as to let me make that in payments, but with a $10 "installment fee" attached. Seems to match the other stories about these people; they just hound you with these scary sounding letters hoping you pay up. With as sorry as that unemployment hearing was, I have little to no fear that this will amount to anything more than these stupid letters.
 
Time for a countersuit for harassment and wrongful termination, I would say.

've gone over this with my parents, and my mom is convinced this is just a bunch of "saber-rattling" by RS and their lawyers. I'm not so sure, because I can't believe they would go this far over something so trivial.

Don't let them scare you. FIGHT IT.

My landlord tried to evict me because I am bisexual - no joke. My old landlord liked me then this new one took over, met me, and a week later I was being evicted for "exteme damage done to the apartment from pets" It was complete bullshit. My place was in perfect shape, not a single stain on the carpet, always clean, etc. I decided to act againts them.

My landlord told me "not to bother because he had the best lawyer in town" and that he had tons of money etc.

I won the court case and he can't pull that crap on me ever again. He needed evidence and his made up, small time stuff he manged to poo out of his butt to try to hold againts me didn't fly in the court. Judges arn't stupid.

I wouldn't write back to this law firm because you don't want to give anyone any ammunition. If anything, you may wish to consult with a lawyer and ask about harassment since that's this firm's motive.
 
Yeah, don't admit to anything, and really, it's probably best not to even communicate with them outside a court setting, or via a lawyer. They are trying to fuck with you, hoping you'll crack and pay up. Don't give them one red cent. Don't give them anything.

I was under the impression that they simply demanded payment from you and that they hadn't sued you. You can't counter sue if you havent been sued.
 
I just got the decision from the unemployment judge...and I won! He affirmed the original ruling of the EDD that I had not committed any misconduct. He stated that it was clear that I did not intend to do the company any harm by taking the cable and that it didn't constitute a loss by RS.

I'll be very surprised (and beyond irritated) if RS tries to appeal this decision, but hopefully they'll accept defeat. They have no reason to keep going, since I am employed and will not be filing another claim, but who knows.

It might not mean any monetary gains, but it's a good victory and gives me more ammunition against these pestering lawyers if they decide to continue harassing me.

As for the harassing lawyers -- ignore them, but save everything they mail you. Don't write a letter, don't call them on the phone -- do NOTHING unless and until they actually serve you with a lawsuit.

Then, the fun begins.
 
Yep. Because if what happened wasn't even bad enough to cause me to lose my unemployment benefits...they'll have a hell of a time even trying to get a case before a judge.
