Then was Picard in the right for assuming Fleet Command?
Considering that he saved the planet, I rather imagine no one held it against him.

Admiral: "I'm glad you're here by the way, your under arrest and to be court martialed."
Picard: "Wait, what? Why!?"
Admiral: "Well, Jean-Luc, you did violate orders by leaving the Neutral Zone to come to Earth..."
Picard: "To save Earth from the Borg!"
Admiral: "And I'm sure that will be presented to the court. However, there is the matter of you usurping command of the fleet from Admiral Hayes."
Picard: "But his ship was destroyed --"
Admiral: "He was still alive, in an escape pod."
Picard: "He couldn't very well command the fleet while floating around in a glorified washing machine!"
Admiral: "I don't see why not? It does have a comm system."
*Two armed guards walk in and seize Picard by the arms*
"You'll be brought before the tribunal tonight and executed tomorrow, if found guilty."
*Next day, Picard is standing infront of the death pit. Admiral Jellico walks out and begins reading the conviction and sentence*
Picard: "Death for insubordination!? This is madness!"
Jellico *staring at Picard intently* "Madness?" *He turns and looks back at Nechayev, who nods* "Madness?
THIS IS THE FEDERATION!" *Kicks Picard into the pit*
