There are no on-screen references to Kirk's death after Generations. He is generally mentioned a few times, but nothing about his death.
Nothing in the post-Generations canon would be disturbed by showing that one of the many loopholes in the film (or any of a dozen other ways) was later used to revive Kirk/ retrieve him from the Nexus etc.
I always saw Generations as the then current regime's way of burying TOS as they went on to launch what they hoped would be an even more successful series of TNG films. Didn't work out that way.
Shatner as Kirk would generate a lot of media attention and interest from the general public. If the film has a good story, it would be an additional boost to help it succeed. Seems to me if the only thing standing in the way of that is 30 seconds in a 13 year old film, never referred to again, you could find a way around it, if it fits their story.
If Nimoy is in it as Spock, it will be disappointing that Shatner did not get in at as well for once last appearance as Kirk.

Hi there...I'm a newbie here so pardon me if I'm bringing up something that has already been discussed. I just wanted to drop an idea since Nimoy et al can't think up a way to bring back Kirk. This has probably been brought up before but on the outside chance it hasn't here goes: In Star Trek: Generations Guinan explains that she is in two places at the same time, in Nexus and in the 24th century aboard the Enterprise with Picard. How do we know that Kirk isn't still in Nexus? Much like the transporter, the Nexus poses metaphysical questions about existence and identity. Since the Kirk that we saw was actually changing the future (wherein Picard's Enterprise is destroyed by the ribbon) how do we know that wasn't Kirk on a completely different timeline? Spock has no way of knowing that Kirk died, so isn't it possible that Kirk could pop up somewhere? Please pardon my ramblings...just wanted to get this idea out. I can't believe those bozo's would not cast Shatner since it's that Kirk/Spock chemistry that works such magic. Thanks for listening.
They don't need to "bring back Kirk." Kirk is going to be in the movie. He'll be played by someone new.
Yep... and the only real "bone of contention" is "how much should the new portrayal attempt to mesh with the old portrayal?"
The two points of view are these:
(1) "Shatner sucks, his version of Kirk sucks, and so give us someone completely unrelated to Shatner. In other words, give us an all-new character, but call that character Jim Kirk."
OR...
(2) "Shatner's portrayal of Kirk is what MADE the character. So cast someone who resembles the guy, and who can (and will) portray the character in a way which is entirely consistent with what the audience expects him to be."
Nobody is SERIOUSLY expecting Bill Shatner to be a motion picture leading-man anymore. He's still a fun actor to watch, but his "action hero leading man" days are well behind him now.

I don't really fall into either category. Shatner really breathed life into Captain Kirk and he certainly forged the template, but I don't think it's necessary to hire someone to be a Shatner clone. There are certain characteristics that can and probably should be duplicated, but if this is a younger kirk, there may be traits that existed unknown to us, that would lead to the swashbuckling hero we see at age 34. Think about how you acted in your twenties vs. later in life.. i expect some differences in character. I hope more realistic thinking fans would agree and be a little more open minded to the portrayal of Kirk.
The next guy to play Kirk will play him in whatever way he and the director think is best. It's really unlikely that he'll try to ape Shatner.
I hope that on Thursday we hear who the new Kirk will be. However, the fact that there've been no strong, late rumors like the ones surrounding Quinto suggests that they may not have narrowed down their casting choices yet.
