After the pathfinder project made contact with Voyager, perhaps the pre-hearing investigations would begin in their absence using information they transmitted back. It would save time for everyone.
About the Maquis crew, I’d like to know why people are so sure that the remaining 12 former members shoud be totally pardonned & offered to be re-admitted to Starfleet?
(Doorbell.)
JANEWAY: Come in.
CHAKOTAY: Good morning. Problem?
JANEWAY: I haven't decided. I've just listened to a communiqu from Admiral Hayes.
CHAKOTAY: Nice to have friends in high places.
ADMIRAL HAYES [on monitor]: Hello, Captain. I hope this message finds you well. From what I understand, it has not been easy, but I want you to know that a lot of people here are very proud of what you've accomplished. I also want to assure you that we have not given up finding a way to get you home. We've redirected two deep space vessels toward your position. If all goes well, they could rendezvous with you in the next five to six years.
JANEWAY: Computer, advance to time index one twenty one point four.
ADMIRAL HAYES [on monitor]: As we get closer and our conversations become more frequent. When you respond to this message, please let us know of any casualties. I'm sure you've had more than your share. I'm anxious to know the status of your crew, the Maquis, first contacts that you've made, interactions with the Borg. But there'll be time for everything. Our thoughts are with you. Talk to you soon.
CHAKOTAY: What?
JANEWAY: Status of the Maquis.
CHAKOTAY: Do you find that surprising?
JANEWAY: I don't think of you or B'Elanna or the others as Maquis. I think of you as part of my crew.
CHAKOTAY: You may have forgotten, but we haven't. You heard the Admiral. It'll be years before we have to deal with those issues. Let's worry about it then.
JANEWAY: Do you have lunch plans?
CHAKOTAY: Is that an invitation?
JANEWAY: I was hoping you'd help me compose a response.
CHAKOTAY: You're on.
Season 6 episode 24.
Janeway did nothing to commute their as yet unlevied sentences or offer amnesty, or pardons without trial.
Chakotay on the other hand did not think that he had done anything wrong, so was not going to push for a trial on Voyager or back when he got to the Federation either, even if there was a guarantee of complete exoneration from Judge Janeway.
He may do that if he felt he was needed, otherwise, he's a career officer. He probably spent 15 years in SF, then left to help his colony for 2 years, then seven more years back on Voyager. It's his life.I'm not sure why Choctay would even want to stay in Starfleet. I think he would be more intrested in helping people from his home planet and other people who were displaced after the Dominion destroyed the maquis find a new home and rebuild.

If it wasn't a crime to be a Maquis, then why was Tom serving a sentence in the NZ prison before the series premiere? What are you guys talking about? There would be no trial. They weren't wanted criminals. Unless there were warrants out for the arrest of specific people for specific crimes. It's not a crime to be a Maquis, and the ones on Voyager weren't Maquis anymore anyway.
