^^^ Uh, yeah, it's frowned upon to use someone's image without their permission to promote your product (especially the President), and frequently results in cease and desist orders or ultimately lawsuits. This really comes as a surprise to you?

I don't get that, on an epic scale.
The billboard on the left is a picture of President Obama from his China trip a few months ago. The company that made the coat he's wearing used the image for said billboard without the White House's permission (which they needed) and are now in the process of taking it down.
AMC's "Breaking Bad" took advantage of the media attention and slapped up their billboard a few weeks ago.

^^^ Not defending the ridiculousness of including that in the TOS, as if people who would engage in such activities would care about iTunes rules or the fact that they might lose their iTunes account, but... You could share sensitive information in images or podcasts uploaded to iTunes via iPhoto or GarageBand with instructions on how to build, buy, or steal those things.
Including it is silly though. You don't need some legaleeze in place to boot someone who's trading already illegal information using your product.
