I heard something kinda vague and I don't know if this is true, that, apparently, there is some kind of licensing issue that prevents Wilson Fisk's character from being part of the MCU (Movies, unlike tv shows) . According to what I looked into, it's because he belongs to Sony. That kinda sucks. Now, with Punisher and Daredevil, they fully belong to Marvel, so they can use them. If those ninjas are the Hand, then I don't think you can do a story about them without Daredevil. That would be like making Daredevil fight a Spider-Man villain alone. But it really sucks if Fisk can't be in BND because if Spider-Man and Daredevil are together, he is the biggest shared villain of them both. Plus, we never saw Kingpin in a Spider-Man movie and it's time. I really hope they can fix this licensing nonsense. They have a weird thing with Hulk belonging to Universal, and that's why he can't get a solo movie anymore.

Yup, his licensing issues have been known for a long time. Even D'Onofrio knows its complicated and that it's unlikely he'll get to appear alongside Spider-Man anytime soon, regardless of how much wants that to happen.

Why can't they just negotiate the Sony deal? --they've already used a number of Spider-Man villains.
yeha by that point this is really getting out of hand. if fisk wasent in the mcu at all then yes i can understand, but now that hes on the new daredevil seasons on disney +. if punisher and daredevil can be on the movies then sony need to give up their nonesense already and just let marvel use anyone they want, now the sony-verse is over anyway. they made a universe which has multiple spider man villians but not spiderman. that dosent make any sense. i guess anything can be solved with disney opening their wallet but i dont think they want to do it because they see no need

But isn't BND technically a Sony Film anyway?

spiderman will always stay sony property, but because they gave marvel aka disney the premission to use him on their universe then they should "release" all characters for marvel to use.

Why?

Sony only allows Peter to appear in movies that aren't produced and distributed by them in order to get Marvel Studios to help them make a profit off of the movies that are produced and distributed by them.

Sony didn't use Kingpin in Brand New Day because they didn't want to, not because they legally couldn't.

but they know fans want it and they are doing a mistake.

Yes, all the Tom Holland Spider-Man movies are Sony releases co-produced with Marvel Studios. Basically Sony owns the film rights but subcontracts the production to Marvel, like how Paramount subcontracted the Kelvin Timeline Star Trek movies to Bad Robot (despite Marvel being the original owners of the character).

Again, though, the Spidey movies are Sony releases even though they're set in the MCU. So they already have the rights to use the full Spidey cast, as we've seen with Aunt May, Vulture, Mysterio, etc. It's only other MCU movies like the Avengers films that limit themselves to using only Spidey, because that's the deal they made -- Sony gets Marvel to write and produce their Spidey movies and set them in the MCU for added audience appeal, and in return, Marvel gets to use Spidey in a certain number of their other films.

So I think the issue with Fisk may be the other way around. Though he was created as a Spider-Man character, he's long been considered a Daredevil character -- which is why he appeared in the Ben Affleck Daredevil movie, because he was licensed along with the other DD characters. So that means the MCU can use him all they want, but Sony would have to license him to appear in a Spider-Man movie. Of course, that hasn't stopped them from using MCU characters like Stark, Strange, and Banner.

It could be a matter of story rather than rights. We don't know what might happen to the Kingpin in Born Again season 2, so we don't know if he'd be able to participate in Brand New Day.

Sony and Marvel Studios share the filmic rights to Wilson Fisk, so, as I said, Sony intentionally chose not to use him in Brand New Day.

All this licensing talk is just smoke and mirrors in my opinion and they are trying to hide the big surprise. Same as No Way Home. Don't trust the trailers or what you read.

Charlie Cox is in the film. That'll be the reveal at the end of Daredevil season 2.
