Well, they are in talks.
I suppose that means if talks go well it might make it into Phase 3 but I'd wager the Phase 3 slate is all but locked.
IM4 could be a 7th film in Phase 3, they did stake out a third calendar slot for an un named film.However, Launching Phase 4 with IM4 seems like a good match.

There is also the news of Sony talking to Marvel about letting Spider-Man in to the Avengers.

This is in the 'nice problem to have' pile.
They're in talks, nothing's been decided. Certainly RDJr commands a big paycheck. And to call Sony talking to Marvel "news" is a significant exaggeration. It's a rumor. Both are possibilities. Both Marvel and Downey like Iron Man movies and Sony and Marvel's relationship isn't cancerous unlike Fox's relationship with Marvel, but one is premature and the other is a rumor. Something to wait and see on (certainly not worth hyping it up as if it's confirmed).
Given how Phase 3's shaping out, I do think opening Phase 4 makes a lot of sense. Although I'm hoping Black Panther opens it, but I'll settle.

And Chris Claremont is supposedly saying that X-Men writers are not allowed to create any new characters so Fox doesn't get them. Although I don't think Claremont is currently connected with the X-Men and he might just be thinking of the House of M storyline (which was just a belief that there were too many mutants), so I'll take it with a grain of salt.
He has an exclusive contract with Marvel and currently writes Nightcrawler for the X-offices, so he may be privy to editorial edicts from higher up.
Iron Man 4? Oh wow. I hope the story thread of the real Mandarin comes to a head.

That's interesting, since that's almost solely what Bendis is doing with his X-titles (introducing lots of brand new mutants).
Bleeding Cool is reporting what Claremont said as well, but added this little bit of information to the article...
This article says that RDJ doesn't actually claim to be in the film. As much as I like his Iron Man, if Marvel wants a sustainable film series they will need to replace actors (similar to the Bond films) eventually. Why not sooner rather than later.

Anyway, RDJ all but came out and said it's happening.
I'd love for Marvel to have all the rights as much as anyone, but cancelling an iconic and long-running comic like Fantastic Four to prevent even the slightest hint of promotion just seems completely petty and idiotic. And really lowers my opinion of the people at Marvel.
