No they couldn't, just because something is on HBO Max doesn't mean it's owned by Warner Bros. Discovery.

Not necessarily, just something is on HBO Max doesn't mean WBD would have produced it, they acquire stuff just the same as a TV network does. So the new seasons could have been released on HBO Max, but still co-produced by Disney.
