Pretty sure the ST'09 Klingon Warbirds are based on rejected ENT concept art, as shown in the ST'09 art bookConcept art for Beyond leads to final product in Discovery. I'd say Paramount has the grounds to sue CBS.
If I remember what Eaves said on his blog correctly, the final design was done by Alex Jaeger inspired by the unused design from ENT. I don't think so. Even if Paramount owns the rights to the concept art, they may have shared it back to CBS if they weren't using it.
