CBS/Paramount sues to stop Axanar

Not much. I don't think the counterclaim does them any good without winning the original claim.

And you're right; the deadline date could be tomorrow (again, I am glad I was never a calendar clerk). Plus PACER does take a day or so, sometimes, to update.

Things have been very quiet from the Axa camp lately, except for AP announced to be going to Denver Comic Con (I think that's the name of that convention) to, apparently, breach his own attorney/client privilege and talk about the settlement talks because, WTF.

You have to wonder if they regret taking him on as a client at this point.
 
Still waiting the news on the counterclaim, but it is rather early still on the day afterwards.

I love how Alec sucks at running a business, but tries to act like that's a good thing.
 
Exactly. The law is pretty clear on what a nonprofit is. The rules exist in order to protect generous, kindhearted people who are in danger of being ripped off.

Oh, so now she (and Alec, by repeating it) *admits in writing* that as a day to day reality they really *are* (not just 'comically hypothetically') paying the operating costs of this facility from customer rentals, with an intent that Axanar Productions ("we") can have a studio to make other things in the future?

The reality of an ongoing in perpetuity for-profit studio benefit (accruing to Axanar Productions == Alec) sustained by reselling the investment-capital value culled from exploiting Trek IP, this is admitted not just as an intent, but an on the record fait accompli?

Up to now they could possibly have claimed that it all (all talk of a studio) was just a temporary thing while they sort out how to accommodate the plaintiffs. Or like so many things, they could have retreated into saying "those were just words, we weren't really doing that, see we are doing something else now" [pivot].

But now they have laid down this milestone in writing, in a way that the studios can use as proof of *successfully executing on intent* to make money off of startup-seeded-from-Trek indefinitely.

I just c a n n o t s e e the studios walking away from this with a settlement that lets them off the hook to have this benefit.

I look forward to what else may be legally admitted at DCC :biggrin:

They are basically doing all the discovery work for c/p.

...and what just amazes me, they are so sure of their validity that they don't think any such admission could possibly have any negative consequences. Or they are sustaining one amazing run of pretending to be sure, with out any cracks in that wall.

Wow. I just don't have the words. What happened to "it's NOT a for profit studio...just a Warehouse..."? And yes, if there's no response to the counterclaim motion; it probably means the parties a near a settlement because IO just can't see Loeb & Loeb letting that go if they're going to continue the case. Yes, the counterclaim is ridiculous, and pretty much would hinge on Axanar receiving a favorable judgment for them on the case in chief.

It shouldn't but it does upset me that (it seems) thanks to Justin Lin and JJ Abrams, the reprehensible actions of Alec Peters will be condoned and Alec Peters propped up by Justin Lin and JJ Abrams as 'Just a Star Trek fan 'celebrating' the Franchise..."

That (IMO) is just wrong on many levels and just plain sad.

Does Diana have an official role in the Axanar Studio/film production? If not could that make posts like that off limits in the case since she's not officially part of the Axanar team, and is not officially speaking on their behalf?
