CBS/Paramount sues to stop Axanar

This whole Horizon thing where Tommy has got the nod from CBS to stop while he's ahead makes me wonder whether, despite APs protestations to the contrary, Axanar ever got 'that' phone call and ignored it?

We've seen a tendency to be deaf to what they don't want to hear, after all.
 
Businesses, even large companies, don't go to the expense of hiring outside law firms and filing law suits without first making a simple phone call, followed by a nicely worded letter from their in-house lawyers. I've read that Axanar claims that neither happened. That moved the needle on my B.S. meter. Moved it a lot.

They got a meeting in person, August 2015, at the Vegas convention. Someone didn't listen.
 
Isn't that where he supposedly asked and begged for rules and guidelines, and they allegedly refused to saying anything other than "we'll let you know when you crossed the line"??? I'd love to hear CBS's recollection of those events. Business execs don't have meetings like that without taking notes, if not recording everything said.

Making a personal statement against someone actually is a bit connected to the length of time you're here.

It's one thing for what's his name to have an issue — he's established on here, and that's fine. But you, you're not ... you're new. But walked into this place like you've been here forever, passing judgement on people who have been here for many, many years.

I have a suggestion for you: stay away from getting personal with the posters, and just stick to the topic at hand. Sound good?

If any call took place the conversation was more like Kraft blasting Peters for being the egotistical p.o.s. he is and poisoning everything for everyone else.
Exactly, and after passing through Peters' narcissistic filter that statement came out as: "Tommy also shared that CBS is apparently planning on contacting other fan productions in an effort to get them to suspend production as well."
 
I am always skeptical when I hear "violator A was told by rightsholder that they will next go after violator B". Why would they share that information?

I dunno, makes perfect enough sense if you parse it back out of the "make Peters look good" filter. Likely just told him that "hey, don't take it personally, we're going through the motions of shutting down pretty much any new production at this point. Things have gotten a little out of control, gotta get back in front of things".

That's not them saying they are going after Production B next, just trying to let him down easy by saying it's not personal, don't freak out about getting sued like that other asshole we're going after. You know, unless you push it and refuse to take the friendly warning like he did...

Bet the phone call just told Peters that and asked why the hell he didn't just quit, they seemed nice enough about it... :)
 
Nothing on PACER this morning (nothing expected, BTW).

It's possible Mr. Kraft was contacted before starting a new round of crowdfunding. That could explain the timing, plus the upcoming conference/potential Doe naming, etc.

Either way, I applaud his prudence. I also hope he can get people behind a wholly original project. He's shown he can do a lot with a small amount of funding. I hope that carries over for him.

Dave Galanter on Facebook's CBS v Axanar group went on a tear I saw.

I am mystified by the notion that somehow Axanar and Peters deserved a C&D, as if the comment in The Wrap wasn't clear enough.

Just because people tend to use my pool for parties and I allow it doesn't mean I will let someone do that and sell tickets (or set up a "donor's wet bar") while having their party ON MY LAND without my permission. And just because usually when it's annoying I tell people "hey, knock it off," doesn't mean I always need to. I can, if I wish, just skip to calling the cops. When I see people getting "donations" for pool noodles and "Dave's special towels" while throwing their party AT MY POOL, that doesn't mean the people trespassing deserved to hear me do anything else than say, "I don't like people throwing parties at my pool and charging people for drinks." (Which, again, was clearly done PUBLICLY with CBS's comment to The Wrap.)

And just because CBS didn't call Peters personally (and who knows if they didn't?) and tell him, "hey, stop this or we'll sue you," DOESN'T MEAN AXANAR WASN'T STEALING. Because THEY WERE. It's one thing for NV and STC and others to play by the pool because CBS/P is willing to allow it. It's another for Axanar to set up shop AS IF IT'S THEIR pool, hire lifeguards (and a pool director in charge of the project who then pays himself a salary) and sell pool merch they call "perks" for "donations." Then, when the pool parties people were having just for fun are cancelled because Axanar took advantage, Peters and his bullies decide to blame the people who own the pool? No. Wrong. Ethically, morally, and legally wrong.

Think he was contacted about being a Doe and now he's pissed?
 
I just remember asking here what his envolvement was and he was clear that Peters should have stopped but not really pissed about it. Now he just seems pissed. LOL.

Dave has also been firmly on the side of CBS/P since the lawsuit was announced.
Yeah it was just like small comments when he posted here so I thought maybe it was more covering his ass but this seemed like really being pissed so I wondered if something changed legally. @DaveGalanter will you tell us what changed?

Statement on the Suspension of Sushi Delivery to Ares Warehouse.

Yesterday, Axanar Productions' Alec Peters received a phone call from Haruto Yoshigawa, the executive chef/general manager of TAKAMA SUSHI regarding a request from his drivers that he no longer offer delivery services to Ares Warehouse due to a lack of adequate compensation/gratuity. Haruto also shared that his drivers had been in contact other food delivery services in an effort to get them to suspend delivery.
While we’re disappointed that deliveries from TAKAMA SUSHI have come to a stop, we were pleased that Haruto's approach was direct and businesslike and not a lawsuit requesting potentially millions of dollars in damages, pre-emptively announced through the industry trade press. By providing a “head’s up” to Alec, Robert, Boomer, Diana #2 and the rest of the production crew at Axanar, TAKAMA SUSHI can avert the legal mess they created when they refused to allow Diana #1 to bring Boomer into the restaurant.
We understand that the kitchen at TAKAMA SUSHI still plans on producing great sushi in the future. We wish them well and will support them in their future endeavors in whatever way we can.
