What is Axanar hoping for? Do you think they are fighting for
1. Continuing to make Axanar as is.
2. Making Axanar in a different universe
3. Keeping the studio/warehouse
4. Not paying damages
From a reasonable viewpoint it seems that CBS would probably settle for 2,3,4. They haven't settled yet so either Alec is trying to insist on making the movie in the Star Trek universe. Or CBS is the hold up and wants to get damages/punish Alec.
You really believe CBS would settle on 2,3, and 4 and allow Mr. peters to effectively see financial and material gain from illegal use of a multi-billion dollar IP.
C/P would demand 2 as well; but their main goal in this action is to show if you don't have a license to use elements of the Star Trek IP from C/P; you will not be allowed to benefit financially or materially. they aren't suing directly on that point; but via statutory and other damages, they are going to make sure that is the result for Mr. Peters and Axanar Productions.
Also, you can be 100% certain that ANY possible settlement would include 2, and ALSO include Alex returning the money collected to Pledgers/Donors (not because C/P care about the pledgers/donors per se; but because it's something they can demand that can be fulfilled; and is effectively showing that Axanar gets zero financial benefit; and further that they quit/terminate the lease and vacate the 'Aeres Studio' space (showing to the world Axanar/Mr. peters again gains zero material benefit from the illegal use of the Star Trek IP.

That's why Mr. peters and Axanar are continuing to 'fight' the lawsuit. They (and I'm sure W&S) would probably take the settlement you propose in a heartbeat because it would effectively allow Mr. Peters to keep the financial and material gains he's received to date; and escape any statutory damage penalties. But I'm 100% sure C/P have not offered anything close to even that because it would send a message of: "Use Star trek to gain all you want. When we sue, you can take us to the settlement table and get a good deal"<--- That's NOT the message C/P want to send.
