CBS/Paramount sues to stop Axanar

I think the whole point of the great time extensions which were written into copyright some years ago was to make this effectively impossible.

Correct. There is no "abandonment" concept in current copyright law. The exclusive rights of the copyright owner last for the entire term of the copyright - even if he/she never showed the work to another person and hid it in a drawer from the date the work was created. The only ways to "give up" your exclusive rights in a copyright are either to transfer them to somebody else or to make a clear definitive affirmative statement that you are intentionally committing the work to the public domain.

Contrast trademarks (such as the term "Star Trek") - trademark rights can be deemed abandoned if the owner goes for some prolonged period of time without using the trademark on any goods or services. But even here, there is no "default time". Rather, even if the period of non-use has continued for years, the law will only find abandonment if all of the other attendant circumstances (in addition to the lapse of time) indicate that the owner intended to cease and not resume using the trademark at some point in the future (for example, the company dissolves, all the factories closed, etc.) For clarity, even if there had been no ST movies or TV shows for years, the continuation of use of the term "Star Trek" on merchandise would be enough to keep the mark from being deemed wholly abandoned.

If the Axanar walled garden readers did get an idea that there was useful content here, finding >10k posts would put an end to investigating it. They need a FAQ, as in, "F**ing Answer these Questions". #1: Where is the written permission from CBS to take money raised by their IP and buy the equipment for a studio. NOT the handwavings of the Axanar management declaring what silence by CBS means, but the affirmative written permission from CBS.

They can ask the question and they will be called a hater, a trader and a troublemaker and booted for creating havoc in the peaceful Kingdom of Axanar.

It's almost like they're doing the work for Loeb & Loeb, guys. And they're retweeting it!

Makes a perverse kind of sense. They hand Loeb & Loeb everything they need to win the case, CBS shuts them down. Then they blame CBS for the fact that Axanar never gets made.
 
And that is why if need by IMHO every studio will come to the aid of CBS/Paramount if they needed to in this case. Because if they don't then they'll all suffer the ruling if it goes against CBS/P. They all may be competitors but you know they all have to be rooting for CBS/P in this fight.

Anyone who is a creator of content, be it a large corporation or the author who is still working to be published should be rooting for CBS/P. Anyone who makes money, or wants to make money from creating content should be against chipping away at copyright.

Even David Gerrold should be rooting for CBS/P.
 
Hmm. Maybe I'm thinking of someone else. I thought he'd had something to say about rights of a writer in the past but maybe I'm muddling him up.
