CBS/Paramount sues to stop Axanar

If the con is putting him up and covering his costs, he probably doesn't see any reason not to go. Never mind the lawsuit, it's a free con!

Not to derail thread but - I wonder is C/P is taking Lucasfilm's recent lead on loading the new project with "respected names from the past" to add credibility with fans who felt the respective franchise had drifted from the "good old days".

Yes and no. I think that's obviously their motive, but I don't think it's right to assume they got the idea from Lucasfilm. The inclusion of Fuller, Meyer and now Roddenberry just makes too much sense given that they are relying heavily on long-time fans coming on board to boost CBS All Access' subscription numbers, while still wanting to take Trek in a new direction.

It doesn't take a genius to figure out how to do that: load the staff with talented and respected TV veterans with a familiarity and/or fondness for the franchise (Fuller), a legendary figure from the past (Meyer) and a symbolic producer for good optics (Roddenberry).

It wouldn't surprise me to see more of this before the staff and cast is settled.
 
I'm not @jespah (thought I respect the hell out of her)- but I'll chime in just to say that the work at issue in that case- and whether it being published or not affected a fair use defense- was the work being infringed - not the work that is accused of being infringing.

So looking at it in two different contexts regarding Axanar's script.

1. The fact that Axanar is unpublished does not bar someone else (say a reviewer of the leaked script) from claiming that his use of the unpublished script is a fair use under copyright. You can make a legal fair use of someone else's unpublished work just as much as if that work had been published

and, from the other direction

2. The fact that Axanar is unpublished does not give Axanar itself any "special" grounds for claiming that its use of C/P copyrighted material should be allowed is a fair use under copyright just because its script hasn't been published (yet).

I'll repeat again that whether or not a script was "published" has no bearing whatsoever on whether that script is infringing copyright. I'm not sure why we keep discussing publication - but if I am missing something, I apologize and please let me know

You're missing the point of my initial question. I never insinuated that lack of publication meant it did not infringe.

Yea, ya kno, legendary explorer and brilliant commander sounds like current CEO self aggrandizement drivel raised to the power of several centuries. Did this commander build the drive that took him there, or map the paths, or solve the questions of how to navigate a space full of random matter? Design the instruments or learn the navigation? Perform any of the critical steps in the critical order to keep the ship together in conflict? do any of the research or infer any of the science upon any of the things found during exploring? design any of the doubtless deep AI that guides the nuances of day to day survival in space? etc?

a) said "go to unknown A, not known B, 'cause we are in the business of going to A"
b) do that very complex thing I understand as "that maneuver"; turn left, turn right
c) threaten pewpew over a viewscreen
d) insist on personally being there to play sun tzu with the most expensive assets ever created, rather than figure out some better solution

Have to say, "legendary" and "brilliant" really sums that skill set up, as compared to the 99.99999999999999999999999999999999999999999% of the thinking and work and enabling being done by everyone else and everything else and all the means that transported his chair to the spot.

I wonder how Alec explains his cloak of secrecy to new "donors" he his hustling up at cons these days. "Like my FaceBook Page!" - but you have to be an approved "donor" first. "Follow me on Twitter!" - but only if I follow you back. It's bizarre, and must be off putting for a lot of potential "donors". "I'm awesome!" - but you can't find me online. Good luck with that.
