When it's a script for a property you don't own - or have a license to create; no it can't. (Well, let me put it this way - Yes, Mr. Peters CAN lile such a lawsuit; but unlike CBS/Paramount's lawsuit - his would get tossed out of court and most likely dismissed with prejudice; meaning he couldn't refile.)
A Trek screenplay has to be a good story, preferably a good science fiction story, that could usually work outside of the Trek umbrella. A few TOS-era tales I've put together have needed some Vulcan skill or Andorian trait and there've been none around. Prelude led me to believe Axanar was a fairly straightforward story.

I agree any blogging about it needs to be really clear not to draw editorial conclusions based on work that may have been completely replaced.
For my part I'm just saying that whatever version, if its great, its great. Who knows yet.
Observing the ego from the producer, I assume the script is all about Captain Garth and his scrappy fight ending with a glorious victory, and not much else. On the other hand, I have no idea how to write a movie and therefore am quite lenient when it comes to quality. I enjoyed the hell out of Insurrection, boob jokes aside. I'd probably have enjoyed Axanar (in the "lightning storm in space" created alternate timeline where it was actually made) had I not learned about the ridiculous behind the scenes shenanigans.
That would be odd since their PR guy already acknowledged that Michael has it.
If it's an earlier version of the script, maybe not.

So let's get this straight:
1) A few months ago, the Axanar team claimed the script had been "locked" thus it was ready to use and although some rewrites would be/could be possible the primary framework was in place.
2) However in their MTD the legal firm representing Axanar stated that the "final" script is not yet complete, thus CBS can't actually be suing them for any copyright violations because their hasn't been any - yet. So either their earlier post about the "locked" script was a lie or their defense is a creative interpretation of objective truth.
3) Over the weekend a reporter received a copy of some version of the Axanar script from person(s) unknown.
4) The script - according to the MTD - CANNOT be the final version, and therefore is not official, protected by any copyright or trademark, and at best is just a rough outline of ideas. Any other classification of this leaked script would reveal that the MTD was just a fancy time waster.
5) No matter how Axanar Productions chooses to classify this script it will logically contain numerous examples of unauthorized and unlawful use of copyrighted characters, locations, and concepts thus making any discussions of "unlawful use" amusing at best.
6) The parties who received the leaked script do not plan on releasing it, rather they plan on excerpting it and commenting on the excerpts as well as reviewing the whole script itself - a plan which does not violate any laws.
7) The response of Alec and his closest supporters was to quickly Google "stolen/leaked script" and then post the first thing that popped up, which of course was a mistake as any follow up would have led them to realize that the actual outcome of the case would not shine favorably on their efforts to intimidate and harass the individual who planned on excerpting and reviewing the leaked copy of the script. In addition Alec and his Axanuts chose to make comments hinting at the terrible things that could happen if the script was leaked - which was stupid because the script was already leaked, and there is no way a person could be sued for reviewing something they received unsolicited.
So in short - Alec and his Marines are desperately trying to prevent the release of something - according to them - doesn't matter anyway, and in doing so they are ignoring facts, law, and plain common sense while demonstrating an inability to read, think, plan, or do anything other than harass and attack. I can see the campaign to capture hearts and minds is going wonderfully.
