CBS/Paramount sues to stop Axanar

I think we are going to see (past the answer) a second firm emerge, to represent the Doe defendants, as they have a set of interests that potentially conflict with AP's and Axanar's. E. g. some might want to settle quickly in order to keep their names out of this suit, whereas AP probably wants to retain Ares (or believe he will be making case law if this matter goes to trial) and so a settlement at this time might not be in his best interests.

I see major conflicts with at least some of the Does. What does a costumer or a makeup artist want with a studio? These are people who probably want to work in Hollywood again, and not detonate every single one of their bridges.
 
Many of those potential Does refuse to abandon the sinking ship. The lifeboats are almost gone. I hope they can swim, I hear there are sharks in the water.

Then I hope the lawyers are responsible about this. I cannot stop seeing conflicts of interest here.

That's what I don't get, particularly if any of them are working on professional careers in the industry. What do they get by staying? How does it outweigh what they risk losing?

It's not just strong, it's pure concentrate if people are willing to ride Axanar Productions into the ground. Here's a tip for all you folks out there: A leader worth following will not ask you to put your professional future and financial security on the line for them. It violates one of the core principles of leadership: "Take care of your subordinates."

This has been in my thoughts too, this reported second attorney(s) coming on; that it's for the Does. For the reasons you speak of as well as perhaps the pro bono original firm may have made a firm deal to represent the production & the producer named in the lawsuit, only.
 
No Does have been named yet, it could just be a scare tactic by CBS. We shall see if they go as far as naming them and pursue them for damages.
 
How, exactly, would the "Does" protect themselves?

Publicly quit the production company? That wouldn't change the penalties for violations of copyright that they have already committed.

Settle privately with CBS? What would CBS require them to do - disavow, provide evidence, something else?
The Does couldn't provide much more evidence than is publicly available or isn't already on file at CBS.

I don't see too many options for the Does other to quietly walk away and hope that CBS is sated by the settlement with Axanar Productions.
 
Well if the Doe left the production when the lawsuit was filed he or she could simply say that they did not know the work they did for Alec was not authorized by CBS (basically play stupid) and left the production when the lawsuit suit was filed. Those who stay on post-lawsuit basically are acknowledging they know CBS has not authorized this and don't care that CBS is suing Axanar. This puts there defense in much more difficult position and opens them up for more damages.

It just don't get why they are taking the risk. I'm not going to say there stupid but I just don't understand the reasoning. Axanar is over, why are you still wasting your time and putting yourselves at risk? Please tell a reasonable answer for this.

Well hope springs eternal, I guess. If AP hadn't gone and put up green screens and made a lot of public noise about costuming and filming and "continuing production", then I would say the Does are just lying low, and could claim they no longer actively were participating in an IP infringing production. However, now they are in a much tougher spot.
 
Good point, many are lying low it seems except for Peter, Diana, Burnet and Terry and some others
 
After the reply - the judge will rule on the injunction. That's imho likely to be granted. Now the production will really stop. Fund raising has essentially stopped and certainly fund raising using Trek or Axanar won't be allowed by the presumed injunction. Expenses continue, lawsuit defense continues, Axanar slowly dies absent a CBS settlement. Does run off. Anyone near the industry just disappears.

And why should CBS settle? If I were them I'd go after the prop business too. They want this guy as far away from their franchise as possible. His "Star Trek" auction is now on the boards for March... Seems to me that's a familiar phrase. Good time to make it go away.

Really all depends on how much of the fans money he has left to pay the rent on the studio. He could possibly pre-pay the rent on the studio for 2-3 more years with the funds he has now. This way if he has to pay damages, and/or go bankrupt, he still has the studio, since he does not own the physical property it would not be an asset he would have liquidate. He could then start to use it to make a profit again. I think his goal is to keep the studio, more than it is to win, or settle, to make the film.
