CBS/Paramount sues to stop Axanar

Remember that Iraq news reporter during the Gulf war what said there are no Americans invading Bagdad, even thought there clearly were. Alec seems like that guy.

Here's Alec over in the Axanar fan group a few minutes ago:


1) We are in deep talks with one of the top 20 IP firms in the country who is very interested in taking our case pro-bono. This is VERY exciting. The quality of lawyers we are talking with who want to represent us is amazing. This is a very high profile case with a high profile defendant and unsettled law.

Given the amount of talent he managed to assemble for the movie, I don't entirely discount this. For what good it will do, anyway...

5) We have stopped taking donations on our Indiegogo as we don't want to mislead anyone with the uncertainty!

Point to Axanar. Most of which is summarily negated by the amount of time it took.

I thought he already had one. In one of the early December posts (before the lawsuit) he mentioned an entertainment law firm that handled their "big legal issues."
 
I'd ask how many people Alec thinks he's fooling with that post, but unfortunately the number of people in the Axanar group provides that sad statistic.

Not just talks, DEEP talks. Because law firms are eager to devote hundreds of unpaid hours to an unwinnable case.

(And yes, I know all lawyers do some degree of pro bono work; I just don't know why they'd use their good will on this case and this defendant.)

Only thing I can figure is that he's trying to find a way to legitimize fan works. I can see how that might appeal to some young up-and-comer in the legal profession. That said, I can't imagine it happening; it seems like a fairly hopeless battle to me.

But hey, a months long court battle between the studios and a small group of smug, bitter fans is a great way to celebrate the 50th anniversary, right?

Let's also remember CBS and Paramount are holding the nuclear option: They can file an amended complaint at any time naming the John Does. I don't think anyone aside from Peters is honestly willing to risk a multi-million dollar personal judgment against them over this film.
 
No wonder Gerrold is mucking around in fan films these days. There's no way someone like that is going to ever get near new Trek with that kind of rude display toward CBS, Paramount and Abrams. Ditto Peters and Burnett.
I'm not in the business but it seems to me Gerrold, Peters and Burnett are rapidly burning their own bridges like a trio of pyromaniacs.

And the sad thing about that is, I so much wanted to see an adaptation of Gerrold's novel The Galactic Whirlpool from Bad Robot and Paramount (I'm sorry, but a two part episode of Phase II won't cut it with me-this needs a million dollar budget to get it right.

This probably also means no more use of Tribbles, too (per what happened with Harlan Ellison and City On The Edge Of Forever). Sad.

Even if he has managed to wrangle a great solicitor who is advising to fight the case (doubtful) and do the work completely pro bono (even more doubtful), he's making no mention of having to pay the barrister he'll probably have to retain.

Those guys aren't exactly cheap, and famous for their charity. I know the US doesn't formally draw a distinction between the two, but they'd still need more than just the one solicitor.
