CBS/Paramount sues to stop Axanar

That happened in the courts here in the UK... Juror turned up for Jury Duty in dress uniform with the pips denoting the rank of Commander - even had a Type 1 phaser on the inside of the uniform jacket

Only UK Trek story I remember is the guy who outfitted his flat like a TNG starship and ended up in jail for being a paedo.
 
My absolute favorite response to this whole thing appeared in the comments section of the Wall Street Journal article on the subject:

Sprinkling in the occasional misspelled Klingon word really makes an incoherent rage-gasm sound like a cogent argument, doesn't it? Also, what heck does "Mok!!" mean? I assume it's supposed to be Klingon, but it sounds like a cartoon sound effect.

I wish someone would call this guy as an expert witness.

I wonder what the other people who supported the production financially feel about him basically telling CBS/Paramount to not just sue anyone working for the production they feel are liable but to also press legal action against the backers too.

If I had donated even $1 I would be rather peeved at him right now for speaking for me.

Oh, and sometimes people like this wonder why Trek fans have a bad rap.

Exactly what he's doing. He's just using the "everyone else is doing it" defense. At least publicly.

Yeah, except that nobody else earns a living off of it. Seriously, this isn't about just one fan film, this is about the whole community. The needs of "everyone else", collectively, outweigh the needs of the few, or the one.

Unless you think Axanar is the Mr. Spock of fan films. :vulcan:
 
This is just so worrisome. I liked the trailer for Axanar, sure, but if every fan film starts getting C&D orders than there will be an explosion of vitriol and it won't be directed at CBS. This is just crazy.

I'm cautiously optimistic.

If I'm CBS/Paramount and I want to shut down fan films in general, I don't file a single lawsuit against the "largest" production; I file lots of lawsuits against all of them, or at least send them immediate C&D's. CBS/Paramount have enough money, and most likely enough legal muscle, to take on more than one small fry at a time and win handily.

That nobody else has been C&D'd, Rengades and others are still up on YouTube (which is an easy one to hit with a DMCA notice), etc., suggests to me that this is exactly what it looks like: CBS/Paramount feel that Axanar specifically overstepped the line.

Of course, I'm not CBS and/or Paramount, nor am I affiliated with them in any way, so take that with a pound of salt or so.

Lawsuits cost money to file and pursue. You usually file one against what you see as the most winnable entity; and AFTER you see the result (IE you prevail or lose, and see what their defense was and how a Judge viewed it) - THEN you begin filing others against people you see doing similar violations if you are so inclined.

(I'm sure Paramount/CBS see this as fairly open and shut case vs Axanar; but the interesting thing in civil law is there's rarely a '100% certain outcome' How they fare in this case will probably give then a template on how best to file and prosecute other cases of this type against other fan film groups should they decide to.)
 
Look, if CBS wins this then they can shut down any other Trek fan film for the cost of a registered letter.*

Because after this no one else will be so unhinged as to resist a direct instruction to stop.

*They can save the cost of a lawyer - the letter can be signed by an intern working in the mail room.

Peters must be a hell of a salesperson, or there are just a lot of ignorant people out there who don't know better. Except apparently at Staples and other copy places near where SeerSGB lives. (He posted way back that he has trouble with Staples people wanting to make copies of forms for him for home school use for fear of treading on a copyright.)
In theory Hansa could be sued, in reality their profit is likely too low to make it worthwhile.

I think they either realized how serious the situation is or got a C&D. The main Axanar Coffee site was finally taken down.

In something he posted on the Axanar site back in August, he said, "we [his company] use less Star Trek IP than almost all of them [other fan film groups]." He talks about things he's gotten rid of, like the delta shield, and says that while they do use several Star Trek characters, they just "try to minimize that."

So it's not so much "everyone else is doing it" as "we do it less than others." Of course, no one has ever done it with a million dollars to spend and the almost explicit claim that this film would be a springboard for launching a new production company.

I think what he doesn't get is CBS doesn't feel threatened in any creative way at all by his project. What he can't see is it's simply wrong to try to make a living, or start a business enterprise using other people's property (for free).

And yet a Klingon battle cruiser and something that looks an awful lot like the Klingon High Council Chambers appear on the coffee. Not to mention the design of the Klingons, a Klingon and the name Andorian appear on the coffee.

So Klingon culture, D6 and Andoria aren't CBS IP?

That is so beyond delusional... Wouldn't the Klingon logo emblazoned on the coffee bag be owned by CBS... "Andorian Ice" you might get away with, but the D6 on the bag, and the rest of it are more than highly questionable uses of the Star Trek license.

Being that Peters has such a hard-on for props and wardrobe from the shows and films ... is anyone else wondering if that outfit Hatch is wearing is perhaps the same one Christopher Plummer wore in Star Trek VI? It sure looks like it...

Well as someone who pledged/'donated' to the first Axanar Feature Film KS - I hope I'm NOT included in any such class action suit against Paramount/CBS and I DON'T want any part of it as Paramount/CBS are definitely within their rights to sue Axanar Productions over copyright infringement. If I thought I could get my Pledge of $75 back; I'd certainly be happy to be part of a civil fraud lawsuit against Axanar - as the KS stated all funds would go toward the production of the proposed film (and not to salaries for Mr. Peters, his wife, and others; and certainly not to airfare/hotel rooms/tickets/media dealer tables at various Star Trek Conventions, etc.)
