CBS/Paramount sues to stop Axanar

Absolutely Right (tm)

GUH, I forgot, technically Viacom owned it all 'till they split the company up, then Star Trek itself was split between Paramount for the movies, and CBS for the TV series, same with merch rights as well, as far as I can tell.

I think CBS owns it all and licenses rights to Paramount. Which is where they come in as Axanar was planning on using Robau and Abramsverse ship designs.

Yes, sometimes it's hard to keep it all in my head as it got muddled a bit due to the Viacom split up.

I wonder if CBS chose to do this this week, the slowest news week of the year and after TFA's hype dies down so they could send a message to everyone else.

Which I thought was stupid. "Man JJ Verse sucks. it's not real Star Trek...but we're totally cool with ripping off JJ verse's characters and designs"

I thought normally people wanted potentially negative stuff to come out this week, because they are more concerned with their holidays than with Hollywood....

I'm wondering why CBS is asking for a jury trial?

As Maurice speculated upthread, to set legal precedent when it comes to fan productions and their crowdfunding.

I saw that but forgot about it, thanks. This is a long thread.

Still, I wonder if CBS thinks a jury will award more damages than if they just ask for summary judgment. I have no knowledge of the law or courtroom procedure, so maybe someone who does will chime in.

The damages are an aside I would think as any win will completely sink Axanar... Well the legal fees alone will do that.

This is a real kick in the teeth to fans. I for one was awaiting Axanar with baited breath - its the first fan production I've really gotten into. I hope they find a way to appease or defeat CBS and go ahead with production and release. It'll be interesting to see how this goes.

Good luck, Alex & team.

I think what this boils down to is Axanar Productions tried to be a big fish in a very large ocean filled with much bigger fish around them... SURPRIZE, you got bit... Let the feeding frenzy start... This is just the tip of the iceberg... And they have the gall to act like they didn't see the Iceberg coming... Talk about rearranging the deck chairs... Okay too many references to the ocean, Titanic, etc.... =P

What happens if they continue to ignore CBS? Going forward with fundraising, perks and coffee? The Indiegogo page is still up.

Sorry JuanBolio, but Alec and company crossed a line with CBS, and since CBS owns the rights to Star Trek, that will be all she wrote.

It's the first one I ever really got into as well. Shame.

Has Paramount/CBS issued a Cease and desist order, or just served him with the suit?

I think Paramount is the one that pushed this the most more than CBS. Paramount does not give as much leeway towards these productions as much as CBS does. This is certainly a tag team effort to bring this to trial. Another reason why it maybe a Jury, is so they show the fans it was a group of regular people making the decision not just a judge only.

There's no way in hell that they didn't know this was coming. My money is on a lot of records of phone calls and emails and letters being sent and covered up/ignored on the Axanar side of the equation.

The delusional rantings of Axanar fans are ridiculous, but not surprising. For months, Alec Peters has been saying that Axanar is more than just a film, it's a movement. (One of the Axanar podcast episodes is actually titled "Axanar Is A Movement")

He's sold these fervent "true-believer" types on the idea that their donations make them part of an important thing that's greater than themselves. It's almost a religion. I'm not saying that's what he set out to do at the beginning. But when things evolved that way he played into it big time. And now that CBS has unleashed the lawyers, these true believers are acting exactly like religious fanatics who believe themselves to be under attack, kind of like when you present a creationist with proof that the Earth is older than 6,000 years.
