CBS/Paramount sues to stop Axanar

Also (sorry for the successive posts, but I'm still on probation and so can't edit yet), according to the latest blog by @jespah Axanar are still going on about Garth being such a minor character and therefore is okay for them to use (or so they argue). But no mention of Soval, who was a recurring character?

I have some idle snarky speculation...

Remember a few months back when Alec -through his PR "rep" Mike Bawden announced that there was going to be a private investor group who would purchase the lease of Ares Warehouse, Studios, and carpet square Center and then also buy all of the physical improvements of the said Warehouse, Studio, and carpet square Center?
What happened to that?

I suspect one of two things:

First, that the deal should have never become public and that someone or several someones helped Alec understand that he should keep his mouth shut. So the deal has been completed, and perhaps that is why there was was some recent activity (a tiny little independent film shot in the parking lot) at the studio.

Second, the entire notion was simply an idea thought up at the little barbecue dinner Alec and some of his fans had after the "Axanar World Tour" went to Tuscon, and had the famous "hallway panel." Alec, in his usual fashion splashed the news about all the social medias, and then a few days later the folks thought better of it, and backed out.

Questions for @bonesmccoy2014

If Axanar ain't Star Trek why is their twitter handle @StarTrekAxanar and why when you go to www.startrekaxanar.com does it go to their website?

It doesn't matter what Axanar calls itself. The reason it is Star Trek news is the copyright infringement and the potential fallout for fandom. It's a newsworthy thing in terms of Star Trek. Not nightly newsworthy, but most Star Trek isn't newsworthy at all.

I'm just saying @bonesmccoy2014 seems to say they aren't Trek and yet they brand themselves as Trek, so... Hmmmm

I hear you. But I suspect that his/her response would be they aren't Star Trek because they infringed. But it doesn't matter. The reason we are talking about it on a Star Trek board and why it's been reported as Star Trek news sites is because it's a big step for CBS, they have never sued a fanfilm before and it affects fanfilms in general.

I doubt @bonesmccoy2014 will be convinced of this reality or not. But these are why it is Star Trek news.

I suspect it's someone from the Axacamp making a lame attempt at damage control. "Casting dispersions" is a phrase I've seen at least once in screenshots of Axacorps rants. Shifting blame for all the chaos from AP to others is another signature of Axaconspirators.

Of course, I could be wrong and it could be just a huge coincidence.

No, I had that impression as well. The whole "this is not star Trek news" thing struck me as an Axanism, as did the repeated beating of a long-dead horse on trying to claim some bizarre conspiracy of collusion between Hinman and Pedraza in order to drag their names through the mud. Hinman has had runins with Peters & Co I do believe, and I wouldn't be surprised if he's annoyed at Pedraza (though I've not heard anything to that effect) for honest reporting, so it wouldn't surprise me.

Guy doesn't pass the smell test.

There. Are. No. Coincidences.

Now this is interesting: The account under the username "bonesmccoy2014" was created way back on 8 NOV 2014, but the first posting (of just 32) by said user was made on Sunday, 1 May 2016 at 1:18-AM.

I am somewhat confused as to why the account sat dormant for almost a year and a half before it was used for posting anything. Just me wondering out loud, but is it possible that someone hacked and hijacked a forgotten and unused account?????

Or that someone created multiple accounts in 2014 to use as backups in case of a ban?

To be fair, one of the ST forums I'm in, for the FASA STSTCS game, has had quite a few people join and not post since it was rebooted a few years back. Granted, it's a small niche forum (300+), but it shows it IS possible.

NEW LAWSUIT FILINGS — Request for Alternate Dispute Procedure No. 1 filed. Parties request to Appear Before Judge Charles F. Eick for settlement proceedings. Filed by Plaintiffs CBS Studios Inc, Paramount Pictures Corporation.

— JOINT REPORT Discovery Plan; estimated length of trial 10-15 days, filed by Plaintiffs CBS Studios Inc, Paramount Pictures Corporation.

This is BREAKING. For background on these items, check out this AxaMonitor article »
Thanks, Carlos! I check your excellent site for news nearly every day. And when I saw this latest addition I thought 'Well, that would be a clever long game Plaintiff tactic wouldn't it; running out the clock.' I mean, that kind of long game (if it is a long game) would get things reset in a way; by refusing early settlement the defendant would necessarily need to restructure their goal due to financial drain which would, like a parent will do, redirect the defendant completely out of the Star Trek game. In addition to possibly slowing this emerging rush into all things bigger and better with technology & massive funding to make our fan films by showing us they are willing to take an active stance if they perceive we are crossing the generous neutral zone they are comfortable with, and us seeing in this lawsuit that there can be big personal (financial financial financial) consequences for doing so. Effectively redirecting us too. Without the Plaintiff necessarily having to draft a definitive list of do's and don'ts. Which list could almost certainly definitively limit us. Which list has been also in their best interests to 'not' make so far.

Sweet.

Thanks for keeping up with the case developments for us, Carlos!

I basically lurked forever too. Sometimes people just lurk.

As a bit of background, the poster here is, most likely, the Orange County pediatrician who posted equally obsessive missives to the CBS v. Axanar page on Facebook. Eventually, he reached the point where he questioned the right of anyone to post on Facebook forum who didn't own IP.

When I suggested that standard was lacking and that if you were really going to set a bar, it shouldn't just be if you owned IP but if you'd actually created the IP you owned, he rage quit the page after refusing to divulge what rights he'd fashioned out of whole-cloth vs. just picked up at auction.

He's pretty obsessed, sees minor details as evidence of major conspiracies, and, in text-book Dunning Kruger fashion, overestimates his knowledge of the law (and a few other things as well.)

Best to push the tin foil box across the table, nod your head knowingly, and otherwise let him be.

Plus, we'd already been discussing Axanar here in the Fan Productions forum since before Prelude came out, in many cases in threads started by none other than Alec Peters himself. Simply Axanar itself has been a pertinent topic on the board since day one.
