CBS/Paramount sues to stop Axanar

A calm, reasonable blog post. I would add that the so-called "Four-Years War" period being covered by "Axanar" already belongs to CBS. Wasn't this period part of the FASA TOS role-playing games' scenarios of the 80s, published under full license to then-Paramount/Viacom and thus wholly-owned by CBS now?

Yep, FASA created the Four Years War concept. Was part of the reason I was looking forward to AXANAR, I is partial to the 'pew, pew, pew'!

I was unaware that Axanar is based on a gaming campaign. So, basically, the movie isn't even based on an original idea. And Peters was gonna try to profit off of a properly licensed property.
My lack of respect for this person has dropped to a new low.
For a real cringy moment, here's Alec Peters (GarthofIzar) posting on Reddit. I'm not a therapist but I think the guy has some real internal issues regarding emotional stability/maturity.

I believe somebody in this thread was looking for that very post earlier, with the "I'm 51 and could still kick your $!@" nonsense.

The guy reminds me of somebody I used to work for. *shudder*

I'd thought that I'd read somewhere John M. Ford had come up with the Four Years' War concept that FASA had run with. I remember reading the source book as my dad and I drove home from DC when he was stationed there for a year. I only mention this because my confusion could give credence to the attorneys' questioning who owns what. Still, even though I was reading a FASA book and hoping my gaming group would agree to a campaign, at no point did I have any confusion about who owned Trek, and it certainly wasn't the fans.

Go listen to their august 2015 podcast I referenced in this post, around minutes 15 to 20 in the podcast I think:

In it, they talk about a game pieces set they are holding in their hands which had been manufactured for them, with Axanar themed ships, and the comentator exclaims, oh look there's a shuttle, and Alec remarks that they already have a license agreement ready for companies who would want it. That more or less this is my recollection. I don't care to go back and transcribe it.

Odd it would be if they were preparing a gaming ship set to license, based on Trek IP, and there were also a twist that its based on a story coming out of the gaming world they'd sell back into. Weird. Probably missing something here.

But CBS should definitely get hold of that game set and the business documents and communications around it.
 
Going back to the "mockumentary" thing for a moment (sorry). Peters has never said it was that. In fact, he's very clear in this video, repeatedly calling "Prelude to Axanar" a "documentary". You can find that around 22:41 into the video.

note a pointed question, and the response from one of the game part makers, claiming in effect as I read it, since they are only selling to Axanar Productions (they are a "vendor"), they aren't subject to the CBS restriction, and besides, Axanar is only making the items available to donors, not selling them:

Ok… I do hope this is happening, because Axanar is one of the most exciting things to happen in Trek fandom in quite a while.

But – can someone at AdAstra explain just how they intend to sell this game, given this statement from the FAQ on the Axanar website:

" Is Axanar licensed by CBS/Paramount?

No, Axanar is an independent project that uses the intellectual property of CBS under the provision that Axanar is totally non-commercial. That means we can never charge for anything featuring their marks or intellectual property and we will never sell the movie, DVD/Blu-ray copies, T-shirts, or anything which uses CBS owned marks or intellectual property."

Considering that CBS lawyers jump up and down on people making Trek-inspired miniatures on Shapeways, let alone selling them as part of a real business, how are you getting around this issue? Surely Axanar Productions cannot issue licences, given their statement?

The long story made short:

So long as the Axanar-related product is exclusively available as a backer reward for the Kickstarter, both Ad Astra Games and Studio Bergstrom are considered vendors. EG, you have to go through the Axanar Kickstarter to get the product & minis when they come out, and Axanar buys them from us to meet the Kickstarter backer needs.

I've been a sucker for miniatures for a while. I'm glad I didn't see his earlier, I may have been tempted to buy some.

they're not for sale. you can :biggrin:, however, donate a staff member a dinner, at the end of which there will be nothing left, and therefore, no profit made.
 
God - they are doing NOTHING with that license but just sitting back and milking us fans for all the money they can get. ;)
I know what you mean, it's not like they went and hired the guy who wrote and or directed the three of the most popular Trek movies to work on the new series....... oh wait.

The guy is unbelievable. I love how just has to bring up all of his business experience even though it sounds like it has nothing to do with their conversation there.
If he had all of those businesses and made $16M selling one of them, then why would he even need crowdfunding to make Axanar? If he's that successful you'd think he could have just financed the whole thing himself.

Said staff member would've profited as it's been said I'm a pretty good cook, not to mention my filming partner who SHOULD been running a restaurant.
 
He has to be broke if he needed that $38,000 salary from fan donations.
^ This. Exactly. He is not what he protrays himself to be. He is a bankrupted businessman with several failed businesses behind him. He brags and brags, and belittles anyone who questions him. He wonders why people "stalk" him around the web. It's because some people care that others aren't taken in by him, believe his bull, and lose money backing him. He's a bully and a fabricator, folks. Caveat Emptor.
