CBS/Paramount sues to stop Axanar

Just because I hadn't noticed before, I see Mike Okuda is now a part of the I stand with CBS group.

Not only that, but Rick Sternbach and Bjo Trimble as well.

I didn't want to publicize any of that. If they wanted to make a spa shy entrance, they're free to do so. I'm pretty sure I added Rick and he confirmed. Mike and Bjo joined on their own volition.

Also don't know if they actually support CBS's claim or Peters' and just wanted to sign up to follow along. The more the merrier either way.

I like that the "I Stand With CBS" Facebook group is open to anyone, including those who support Axanar or are part of the so-called Axanar Marines. I'm even glad Burnett is part of the group. It's good to have an open discussion, even if I may not like what some of the Axanar supporters have to say on the page.

It's as if there's some litmus test for being a fan. If you don't like this kind of Trek and prefer this kind of Trek, then you're not really a "TREK loyalist" (Burnett's term) or True STAR TREK fan.

And I'm sick of this, not just from the AXANAR group but from fandom in general.

I don't care for DS9 or VOY or much of ENT, but I don't go around telling fans of the show that they're wrong for liking it. Or tell them that they aren't true fans because they don't watch TOS or like the new Abrams' movies.
I like most of Trek. I am thrilled with the JJ films. They allowed my brother and sister-in-law into my world, for one thing. And I like seeing how the characters reacted in a new timeline. Somehow, Nyota Uhura got through to a socially isolated Spock. Without his father, James Kirk might've become a career criminal, save for intervention by Captain Christopher Pike. That's amazing!

I only consider scenes with neelix in them to be true trek - I reject everything else.

Well Denise Okuda "liked" a joke I made in the group. It gave me more of a thrill than it should have.

Yup. I don't care for JJ Trek or Voyager and have had very vocal opinions on both, which I vehemently stick by. But I recognise the right of any fan to enjoy them. They are part of the franchise and I, you, Peters, Burnett and anyone else isn't a barometer of what makes a fan.

True fan bullshit be damned.

Yeah. Rich Sternbach came to my FB page to wish me happy birthday last year.

They are decent people, the ex-Berman Trek folks. Even Berman himself has been good to me in the past. Shame they aren't on the franchise anymore. I think that's an era of Trek that, and a set of creative people, that deserves a great deal more credit than they get.
 
I think he wanted to show Alec how it's done - present a calm, reasonable, cheerful and friendly face to the critics.

I'm afraid he's discovered that not many people are interested in discussing the quality of the Axanar work now.

Well that fact is they're not being sued over quality, they're being sued over IP theft. So they're no need to convince critics one way or the other, cause that's not what we're talking about.
 
The problem is, if CBS/Paramount secures a monetary judgment against Axanar Productions, the company will almost certainly file for Chapter 7 bankruptcy.
That is not a given at all. It's not the first time you have posted this. It entirely depends on the nature of the judgment, whether or not it is the most preferable option (such as how feasible it might be to continue operating in terms of non-Trek business) and just how solvent the debtor/s is. It also depends on any enforcement proceedings the Plaintiff may seek to pursue.

Remember that the suit names people personally as well as the company. You have no idea of the personal wealth of any of the other defendants and how much they will be joint and severally liable for the overall debt, or what orders the court might make in that regard. It may not be necessary to declare the company bankrupt at all if any debt can be discharged collectively or solely by the other parties.

If anything, the time that bankruptcy would be more cut and dried would be if a subsequently claim for refund was made by the donors as that would likely be directly against Peters and/or the company and of a value that will almost certainly exceed the assets of either.

You're correct, I misspoke. I was not accounting for the John Does. I was assuming a scenario where the judgment was obtained against Axanar Productions and Peters alone. As you said, this is a "fluid" situation.

To be serious though yes thats what is wrong with the fandom, parts of it have become really toxic when it comes to not recognising we don't all like exactly the same thing from this universe and have different opinions and tastes.

Least people are talking even if they are disagreeing... Its the mud slinging and assertions that anyone who believes CBS have a legitimate complaint somehow want CBS to steal the project from the fans.

In other news the campaign to have CBS drop legal proceedings is edging close to the 7500 signature goal, I would have thought it DG etc were right about the fans and a firestorm of hate it would have blasted past that mark at Warp 9!

You know they could totally take the script and put it into the STAR WOLF universe. I hadn't thought about it until your post, but AXANAR fits more there than it does in STAR TREK.

Talk about filing off the numbers ... and getting Gerrold to back them more. ;)

If they did do that though CBS would still have them on the fact the start up costs for the studio and film were bankrolled on the Star Trek IP, plus I would assume at that point Gerrold would have to admit to having a dog in the fight?

Back in the day, I used to take my digs at Berman and Bragga. But the more I learn about the behind-the-scenes stuff on Trek and learn about the industry, the more I've come to respect both of them and appreciate the difficult situation they were in with trying to keep both fans and the accountants happy.
