CBS/Paramount sues to stop Axanar

Dear fans:

We at Axanar have been working our butts off to bring you the best Star Trek we possibly can. Obviously CBS has put up a big road block, which we are dealing with. We want you all to know that your continued support is very heart warming.

We had a big meeting yesterday that will have a big impact on the future of what we do. In that meeting I can tell you that YOU the donors were constantly referred to. We are always talking about you all and how we make sure you get a product YOU will be happy with.

You are all very important to us. We do what we do not only FOR you, but BECAUSE of you. And we are forever indebted to you for allowing us to take this journey with you.
So it was interesting when this came across my desk today:

Technically, he's taken the goalposts down from someone else's field and is now trying to get them off campus before the cops notice.

It's as if there's some measure to being a TREK fan. Some litmus test. There isn't.

Probably not. Because they've already violated the IP with Prelude, as well as their perks.

Will filing the serial numbers allow them to make their film? Possibly. And their sets are in such a state that they can easily change them to generic starship sets.

Will they get more donor money? Probably. They've built up such a feverish support group. Those donors will open their wallets to show CBS that they can't stop the Axanar juggernaut.

It might. If they cease ALL usage of Trek images, character names, planets... all vestiges of Trek, and offer to pay a certain amount of damages CBS may just be happy to avoid court, and the negative fan perception that could come with that.

Now the larger question is would the donors tolerate a generic, Trek-like sci-fi adventure based on the Axanar movie script? I think for a good percentage of them; especially the "true believers," that answer is yes.

Then of course the question becomes is do those who donated but do not support the idea of Space Track: Azxnarx The Movie have an opportunity to get their money back?

It also depends on any enforcement proceedings the Plaintiff may seek to pursue.

Remember that the suit names people personally as well as the company. You have no idea of the personal wealth of any of the other defendants and how much they will be joint and severally liable for the overall debt, or what orders the court might make in that regard. It may not be necessary to declare the company bankrupt at all if any debt can be discharged collectively or solely by the other parties.

If anything, the time that bankruptcy would be more cut and dried would be if a subsequently claim for refund was made by the donors as that would likely be directly against Peters and/or the company and of a value that will almost certainly exceed the assets of either.

They paid for Trek. If not all, some at the very least will want a refund and Axanar won't have delivered on their promise.

It sounds to me like he just got a big dose of Reality.
 
I'm not a lawyer but it seems to me that the people with the greatest claim on Axanar's assets are the people who have sustained actual tangible loss here, as opposed to hypothetical potential loss, which is what CBS/Paramount are claiming.

The problem is, if CBS/Paramount secures a monetary judgment against Axanar Productions, the company will almost certainly file for Chapter 7 bankruptcy. And in such a circumstance, any claims the donors have (which would basically be for breach of contract) would be unsecured debts. So they're likely to get next to nothing.

So I won't be getting my $15.00 back??? SHOCKER...

Ha, I wouldn't get too excited. I'm simply saying that litigation is organic and can change as it goes along, with factors that are unknown now impacting the outcome.

What I would be prepared for is to see not the Axanar itself and at some point facing the prospect of having to ask for your money back.

Even if there is bankruptcy the trustee still have to try and settle as many debts as possible. Some doners might get lucky of the judgment debt can be discharged without bankruptcy. Bankruptcy is only something that occurs when it's clear the debtor can't repay and, like I say, in the CBS litigation there is potentially 22 debtors because of the John Does, and even then CBS could apply to add more if more were revealed.

The whole case is essentially a script not yet fully written.

A great deal of people involved in this debate including Peters, have advanced the idea that people who stand with CBS are pro JJTrek and vice versa. It's a totally spurious argument.

It's as if there's some litmus test for being a fan. If you don't like this kind of Trek and prefer this kind of Trek, then you're not really a "TREK loyalist" (Burnett's term) or True STAR TREK fan.

And I'm sick of this, not just from the AXANAR group but from fandom in general.

I don't care for DS9 or VOY or much of ENT, but I don't go around telling fans of the show that they're wrong for liking it. Or tell them that they aren't true fans because they don't watch TOS or like the new Abrams' movies.
 
Just because I hadn't noticed before, I see Mike Okuda is now a part of the I stand with CBS group.

Not only that, but Rick Sternbach and Bjo Trimble as well.

I didn't want to publicize any of that. If they wanted to make a spa shy entrance, they're free to do so. I'm pretty sure I added Rick and he confirmed. Mike and Bjo joined on their own volition.

Also don't know if they actually support CBS's claim or Peters' and just wanted to sign up to follow along. The more the merrier either way.

Hey, I didn't "buy" a Blu-ray. I received a "perk" for making a donation to support Amazon's infrastructure costs.
