CBS/Paramount sues to stop Axanar

I think the lawyers have a better handle on what to do than anyone here, albeit they might get a laugh at some of the anecdotes about Alec being shared.

I could see them using research folks to maybe scan social media for things, alert them to anything they could use.........that might lead them here. I am amazed at the shear amount of time the Alec spends on all the boards and forums giving orders to his MACOs. You would think he'd have more "work" to do. Maybe playing online is part of his "60 hour" work week he bills for.

Gadzooks, I hope this doesn't hit fanfic writers but, if it does, I'll take my stuff down. I kinda like my house and want to keep it.
Yes, this post was over 60 pages ago (I gave up trying to catch up after page 17), but I just wanted to make this comment:

Fanfic has been going on for decades prior to the internet. My fanfic collection started in the '80s, when I corresponded via snailmail with the people who wrote and published it. I very much doubt that fanfic would totally go away even if certain sites were shut down (of course I hope that doesn't happen).

You're not claiming that you own Star Trek or its characters, etc., right? Every fanfic site I'm aware of carries some sort of disclaimer stating that they don't own Star Trek and no copyright infringement is intended (that's a requirement on fanfiction.net; as far as I know, the authors have to post some variation of a disclaimer on every page of their stories).
I'm a little worried about fanfic too because there's so much of it. Plus, I'm also worried about people who play in online roleplaying games set in the Trek universe (and the tabletop players too). I'm not too sure about them because CBS/Paramount does have officially licensed roleplaying products.
Well, it's not like they can swoop in and grab anything you've already downloaded, and for sure I'm not worried about anyone marching into my home and confiscating my several hundred print 'zines I've collected over the past 30 years. Nor can they burst into your home and prevent anyone from engaging in RPGs (unless you mean the ones played online).

Some years ago Marion Zimmer Bradley/her estate cracked down on Darkover fanfic. Some sites will not allow it to be uploaded/archived, and there was an order that "if you have written any Darkover fanfiction you must either destroy it or rewrite it so it has nothing to do with Darkover or anything recognizably Darkovan"... uh-huh. They can patrol the internet, but my bookshelf and any stories or poems or songs I write solely for my own amusement? Good luck with that.

If CBS decrees that no more Star Trek fanfic shall be available online, it would just go underground/snailmail as it was in the '60s-'80s. I don't know how many millions of stories, poems, or songs exist, but fanfiction.net has approximately 25,000 stories classified as TOS, TNG, DS9, VOY, and ENT alone... these don't include stories based solely on the movies, nuTrek, or crossovers. That's just one site. There's a lot of fanfic that never was online - decades' worth. And even if some old print 'zines are scanned and uploaded, those don't usually include illustrations, poetry, songs, comics, and other miscellaneous material.

IOW, they can try to stop it (yes, they have the legal right to do so if they wish) but it's really not a realistic goal. And since most fanfic writers are smart enough not to step on anyone's legitimate copyrights, I can't see them making a serious fuss about it.

Honestly, all they'd have to do is hang out over at the Axanar page and just follow it all. Everyone there has practically made their case for them.

I would think in this day and age, they have fairly tech savvy staff in law offices who deal with IP who's job it is to hover stuff up and worry about analysis later... you can automate a lot of the process.

Anyone notice on their "fiscal report" that the salaries line item is a bit above $48,000, yet the actual salaries add up to $73,000+?

I would point out that blogging on BBS is only so helpful. If you find this behavior and fund raising unacceptable - then go to Indiegogo to notify them. Include details and the CBS complaint. I would hate to see fan money (more fan money) go to a venture at odds with the owners of Star Trek.

There is no "try" someone said.

You do realize people have already done this.

I didn't bother to do the math, until someone mentioned that on the BBS..... so basically they paid out over 100K in salaries

Oh man.... the "Marines" they are exhausting.....

Do you mean over on Facebook?

Yea... I feel like I am talking to my 5 year old...

"When you take something that isn't yours that's called stealing"

"I don't care, I wanna play with it"

loofa.......
Yeah, I'm trying to educate someone on how "A portion of the sales price goes directly to the film-makers of Axanar" is NOT the same as a perk or a thank you gift from an NPR pledge drive. Oy.

loofa.......

My 3-year old and 1 year old are encouraged to share, and that there's no problem with the 1YO playing with the 3YOs toys as long as long as the 3YO isn't stopped from using it (and vice versa)

I guess that's not the american way though.

I remember vaguely AP stating that, contrary to TTI, Axanar would be completed.

And here we are today...

Oh, perhaps you mean this gem of a passage?

Happy your shoot went well John. Excited to see the final product. This is truly a remarkable effort.

I can't help the irony that this 30 year old fan film is going to get finished and released before Exeter. You should be commended for your efforts John!

[Note: this is from a thread about Yorktown: A Time to Heal, a fan film which is still, today, nearly a year from it's completion and release as detailed by its producer.... which would put it out more than two years after Starship Exeter's "The Tressaurian Intersection" finally came out.]

There is a difference between sharing of your toys and taking toys that are not yours to take...

Anyway, the Salaries section makes no sense. The formatting is FUBARed and you can't really tell what number belongs to whom. But when you add up all the numbers

Salaries
$17,420.00
$38,166.57
$5,000.00
$9,800.00
$48,042.31
$118,428.88

Monday, January 4th, 2016 Well, today was the first full day back and much was dealing with lawyers. One of the things all the arm chair lawyers on Facebook don't seem to get, is that a legal case is much more than what is in the complaint. People were all claiming they knew why CBS was suing Axanar.
We were too big!
We were making to much money!
We were paying crazy salaries to employees!
We are too good and Paramount is scared!
I could go on. But the point is no one knows and no one bothered to read the complaint, which says none of that.
We won't be commenting much on the legal case as we are in discussions to settle the situation. What I can say is that all those arm chair lawyers have absolutely no clue what is going on in those discussions. And no clue what CBS and Paramount thinks.
We hope to amicably resolve the situation in a way that benefits CBS, Paramount, Axanar and all fan films.
