CBS/Paramount sues to stop Axanar

    Alec took to the main Axanar facebook page to throw shade on STC....comments not going like he thought they would. #giggles

    Alec won't relitigate anything by throwing shade. Nor will he buy time or credibility. The only thing that can save him is producing a film. On the small amount of donations he can probably raise. Oh, woe. Has to make an actual *fan film* :guffaw: Found himself in his own worst nightmare?

    1. re Alec's comment: anyone could see CBS/P having all the motivation in the world to turn a blind eye to a good faith operation *because* of what Axanar did. Du-uh.

    2. re feedbacks: now *that's* shade. *That's* a donor base.

    Okay, putting aside the obvious, is it even inconceivable that STC could plan, shoot and complete production on FOUR episodes since the guidelines??

    God the man is something else.

    Well, 17 months ago I didn't know who Alec Peter was. Now he's a well known comedy writer (though not intentionally) who has kept us entertained for over a year now. Maybe Britto can pick up the mantle...

    I'm kinda old and retired; I take my entertainment where I can!

    That's exactly what happened per an interview with Grant Imahara. STC had already raised their fund for their remaining episodes before the fan film guildlines were released. They approached CBS/Paramount, and asked for permission to allow the production to fulfill the episodes they raised money for from donor contributions. They were given permission to complete the episodes.

    Nuh uh, nope, fact-checking shows what is said there is inaccurate.

    It went like this: [Now with Added Clarification from @carlosp EDITED IN}

    Late 2012/early 2013 STC maps a Project to produce closure to Star Trek's original five year mission that its 'own' TPTB cut short by two real time seasons and the last fictional year of the mission. STC's Original Series Completion Project would have a finite number of episodes.

    2013 STC released the first episode in their Original Series Completion Project. (which as soon as I found it I also immediately became a donor)

    2014 STC releases two more episodes in their Original Series Completion Project.

    2015 STC releases two more episodes in their Original Series Completion Project.

    End of December 2015 CBS/P filed a lawsuit on the production & defendant. An injunction was placed on it. [EDIT as per @carlosp information = injunction was sought rather than placed on it]

    No other productions in process heard from them.

    In early 2016 Tommy Kraft releases Horizon. No dissent is heard from C/P.

    During that same time STC runs a crowdfund to finance its final productions in its Original Series Completion Project. No dissent is heard from C/P at the time. (Mr. Mignogna also stated he would not play Capt. Kirk after the Project completed because his age would not allow him to pull it off believably.)

    Mr. Kraft then announces his plan to crowdfund and create his second Star Trek movie. He receives a call from CBS respectfully (as per Mr. Kraft) suggesting his newly planned second crowdfunded ST movie may need to be rethought at that particular time because of the on-going lawsuit with the production.

    I 'think' this is the time the injunction against the production was lifted and they were permitted to make it at their discretion. [EDIT for clarification per @carlosp = injunction was 'not' lifted as the injunction had only been sought]

    STC continues its production on the final episodes of their Original Series Completion Project.

    Thiswholething was becoming full blown and nasty in Every Way during this time. Crowdfunding was not doing well. Private donors to STC stepped in to complete the funds needed for the final episodes in the STC Project which would conclude their own five year mission plan for their Original Series Completion Project.

    The Guidelines are posted.

    2016 STC releases another episode in their Original Series Completion Project.

    I have not heard about any dissent from C/P for that 'single' episode or the completion of the STC series completion 'Project' as a whole body.

    Therefore, since STC is producing to completion their Project one could reasonably assume that their Original Series Completion 'Project' is being considered as a whole work already funded and in active production with large blocks of it already finished and up, and therefore the final parts (episodes) in the finite Original Series Completion 'Project', funded and in various stages of Very Active Production, are being permitted to grandfather in as per Mr. Van Citters' confirmation that productions already in progress were exempt from the guidelines.

    [EDITED IN after listening to Engage podcast from point 26:00 per @carlosp's suggestion to see that the 'word' grandfathering or even 'implication' of grandfathering is not used or implied by CBS representative John Van Citters who explained the new Guidelines in that Engage podcast.]
    Q: “They already exist, they're on the Internet, are you (CBS) going to chase them down and tell them to remove them from the internet?”

    Van Citters: “Absolutely not.” <lots more words addressing this> [= what's done and up is done regarding all guideline conflicts. guidelines meant for films on a going forward basis]

    Q: “Let's say somebody raises their money, they follow the rules, they shoot it, they cut it, they got it ready to go, they're about to put it up on a streaming platform; do they contact you for a review?” <more words> “I mean, you're not reviewing each of these are you?”

    Van Citters: “No. We're not reviewing” <lots of words addressing 'reviewing'>

    Q: “Some of those bigger productions, a handful of them, you have been in touch with them <lots of words> you're not springing a surprise on them, they're not springing a surprise on you. Is that correct?”

    Van Citters: “That's correct.” …<words>... “We do treat every use of our IP on a case by case basis. We do not like to paint with a big broad brush and tar and feather everything in a specific way just because that is the most expedient.”

    Personal editorial giving opinion:
    One IP-using production thrown under the bus by defendant is given a CBS license to use the production's stage facility as a revenue producing tour.

    One IP-using production, the defendant, is sued to stop IP use as Independent Star Trek. And is otherwise allowed to go forward with fan films but only as directed by Guidelines.

    One IP-using production still being thrown under the bus by the defendant appears to be allowed to continue using IP to their Project's planned end without compliance with Guidelines.

    Oh. I didn't see your post before I posted my own on this.

    I suspected there had been communication between STC & CBS on this. To continue to produce without having come to some kind of agreement with them wouldn't make sense to me. I just confidently presumed I had not yet heard that this had actually happened.

    Let's be honest; there is a huge difference in a true non-profit production that has raised money and have done everything they stated they would do compared to Axanar who took in huge sums of money and said a bunch of great things but really did not do anything they said they would. It is interesting to look at the results of both; STC in the end will have produced 11 episodes for less than half of the money of what Axanar raised. All Axanar produced is a 20 min. greenscreen / CGI short and the infamous "Vulcan scene" which was also green screen / CGI. It seems clear why CBS would have issues with Axanar. This is what drives me crazy about these people who bitch about CBS being against the fans; THEY DID THIS TO PROTECT THE FANS from what appears to be a con man.
